Opportunity description

The subject matter of the contract is the supply of cytostatics and medicinal products from drug programs (CPV: 33.69.00.00-3, 33.65.21.00-6) for the needs of Copernicus Podmiot Leczniczy Sp. z o.o. in Gdańsk, the detailed description, assortment and estimated quantities of which are contained in the Assortment and Price Form - Annex No. 1 to the SWZ (parts Nos. 1-235). The offered subject matter of the contract must be authorized for marketing and use in accordance with the applicable provisions of law. The subject matter of the contract must comply with the Act of 7 April 2022 on medical devices (Journal of Laws 2022, item 974, as amended) and/or the Pharmaceutical Law Act of 6 September 2001 (Journal of Laws 2022, item 2301, as amended) – if applicable. In the case of an assortment specified using trade names, the Contracting Authority permits the submission of tenders for an assortment equivalent in every respect, i.e. composition, weight, range, spectrum and duration of action, form, function, etc., provided that they guarantee performance of the subject matter of the contract in accordance with the assumptions set out in this SWZ. In the case of an equivalent assortment, the Contractor is obliged to specify its trade name, catalog number and the manufacturer’s name. The burden of demonstrating the equivalence of the offered solution or equivalent solutions rests with the Contractor. In all provisions of the SWZ and its annexes in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems, or where trademarks, parameters or sources of origin (names of manufacturers or devices) are indicated, pursuant to Art. 99 sec. 5 and Art. 101 sec. 4 of the Pzp Act, the Contracting Authority permits equivalent solutions. The manner of performing the subject matter of the contract is specified in the draft agreement contained in Annex No. 5 to the SWZ. The Contracting Authority does not reserve the possibility of applying for the contract exclusively to Contractors referred to in Art. 94 of the Pzp Act. The Contracting Authority does not impose the requirements referred to in Art. 96 of the Pzp Act. For the purpose of submitting a tender, the Contracting Authority does not envisage the Contractor conducting a site inspection or inspecting documents necessary for performance of the contract that are available on site at the Contracting Authority. The Contracting Authority does not require the submission of subject-matter evidence together with the tender. Contractors may apply for the award of the contract if they: Are not subject to exclusion, Meet the conditions for participation in the procedure concerning: capacity to conduct business activities – the Contracting Authority does not specify a detailed condition in this respect; authorization to conduct a specific business or professional activity, insofar as this results from separate regulations – the Contracting Authority will consider the condition fulfilled if the contractor submits a current authorization to conduct the activity covered by the subject matter of the contract, i.e. an authorization to operate a pharmaceutical wholesaler or an authorization to manufacture, if the contractor is a manufacturer, or, as appropriate, in the case of a contractor operating a consignment warehouse – an authorization to operate a warehouse containing rights concerning trade in medicinal products – if applicable, economic or financial standing - the Contracting Authority does not specify a detailed condition in this respect, technical or professional ability - the Contracting Authority does not specify a detailed condition in this respect. Contractors may apply for the award of the contract if they are not subject to exclusion from the procedure due to one of the circumstances indicated: a) in Art. 108 sec. 1 of the Pzp Act, which occurred during the relevant period specified in Art. 111 of the Pzp Act, b) in Art. 7 sec. 1 of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security, c) Art. 5k sec. 1 of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No. 833/2014 concerning restrictive measures in view of Russia’s actions destabilizing the situation in Ukraine (hereinafter: EU Council Regulation). The Contracting Authority does not envisage exclusion on optional grounds for exclusion of the Contractor (Art. 109 sec. 1 of the Pzp Act). The Contracting Authority may exclude the Contractor at any stage of the contract award procedure (Art. 110 sec. 1 of the Pzp Act). In particular, for the purpose of implementing the prohibition referred to in Art. 5k sec. 1 of the EU Council Regulation, before concluding the public procurement contract, the Contracting Authority may require the Contractor to confirm that the declaration submitted in this respect remains current. The Contractor is not subject to exclusion under the circumstances specified in Art. 108 sec. 1 points 1, 2, 5 of the Pzp Act if it proves to the Contracting Authority that it has fulfilled the conditions indicated in Art. 110 sec. 2 of the Pzp Act. From a contract award procedure, in the case of a contract with a value equal to or exceeding the equivalent in Polish zlotys of the amount for construction works – 20 000 000 euro, and for supplies or services – 10 000 000 euro, a contractor shall be excluded if it prevents or hinders the determination of the criminal origin of money or conceals its origin, in connection with the inability to determine the beneficial owner within the meaning of Art. 2 sec. 2 point 1 of the Act of 1 March 2018 on counteracting money laundering and terrorist financing (Journal of Laws of 2019, items 1115, 1520, 1655 and 1798) - Art. 108 sec. 2 of the Pzp Act. The Contracting Authority informs that it will examine and evaluate the tenders and then perform the subjective qualification of the Contractor whose tender received the highest score with regard to the absence of grounds for exclusion and fulfillment of the conditions for participation in the procedure. Accordingly, Contractors do not submit together with the tender the JEDZ declaration referred to in Art. 125 sec. 1 of the Pzp Act. Before selecting the most advantageous tender, the Contracting Authority will call upon the Contractor whose tender received the highest score to submit, within a specified period of no less than 10 days, subjective evidence current as of the date of submission, as specified in § X of the SWZ. The Contracting Authority does not require a performance bond.
