Opportunity description

The subject matter of the contract is the supply of cytostatic drugs and medicinal products from drug programmes (CPV: 33.69.00.00-3, 33.65.21.00-6) for the needs of Copernicus Podmiot Leczniczy Sp. z o.o. in Gdańsk, the detailed description, assortment and estimated quantities of which are contained in the Assortment and Price Form – Annex No. 1 to the SWZ (parts Nos. 1-235). The offered subject matter of the contract must be authorised for marketing and use in accordance with the applicable provisions of law. The subject matter of the contract must comply with the Act of 7 April 2022 on Medical Devices (Journal of Laws 2022, item 974, as amended) and/or the Pharmaceutical Law Act of 6 September 2001 (Journal of Laws 2022, item 2301, as amended) – if applicable. In the case of an assortment specified using trade names, the Contracting Authority allows tenders to be submitted for an assortment equivalent in every respect, i.e. composition, weight, range, spectrum and duration of action, form, function, etc., provided that it guarantees performance of the subject matter of the contract in accordance with the assumptions set out in this SWZ. In the case of an equivalent assortment, the Contractor is required to specify its trade name, catalogue number and the manufacturer's name. The burden of demonstrating the equivalence of the offered solution or equivalent solutions rests with the Contractor. In all provisions of the SWZ and its annexes in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems, or in which trademarks, parameters or sources of origin (names of manufacturers or devices) are indicated, pursuant to Art. 99(5) and Art. 101(4) of the Pzp Act, the Contracting Authority allows equivalent solutions. The manner of performing the subject matter of the contract is specified in the draft agreement contained in Annex No. 5 to the SWZ. The Contracting Authority does not reserve the possibility of applying for the contract exclusively to Contractors referred to in Art. 94 of the Pzp Act. The Contracting Authority does not impose the requirements referred to in Art. 96 of the Pzp Act. For the purpose of submitting a tender, the Contracting Authority does not provide for the Contractor conducting a site visit or inspecting documents necessary for performance of the contract that are available on-site at the Contracting Authority's premises. The Contracting Authority does not require submission of subject-matter evidence with the tender. Contractors may apply for the award of the contract if they: Are not subject to exclusion, Meet the conditions for participation in the procedure concerning: capacity to conduct business activities – the Contracting Authority does not specify a detailed condition in this regard; authorisation to conduct a specific business or professional activity, where this follows from separate provisions – the Contracting Authority will consider the condition met if the contractor submits a valid permit to conduct the activity covered by the subject matter of the contract, i.e. a permit to operate a pharmaceutical wholesaler or a manufacturing permit if the contractor is a manufacturer, or, as applicable, in the case of a contractor operating a consignment warehouse – a permit to operate a warehouse that includes authorisation to trade in medicinal products – if applicable; economic or financial standing – the Contracting Authority does not specify a detailed condition in this regard; technical or professional capacity – the Contracting Authority does not specify a detailed condition in this regard. Contractors may apply for the award of the contract if they are not subject to exclusion from the procedure due to one of the circumstances indicated: a) in Art. 108(1) of the Pzp Act, which occurred within the relevant period specified in Art. 111 of the Pzp Act, b) in Art. 7(1) of the Act of 13 April 2022 on Special Solutions for Counteracting Support for Aggression against Ukraine and for Protecting National Security, c) Art. 5k(1) of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No. 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (hereinafter: EU Council Regulation). The Contracting Authority does not provide for exclusion on the optional grounds for exclusion of the Contractor (Art. 109(1) of the Pzp Act). The Contracting Authority may exclude the Contractor at any stage of the contract award procedure (Art. 110(1) of the Pzp Act). In particular, for the purpose of implementing the prohibition referred to in Art. 5k(1) of the EU Council Regulation, prior to concluding the public procurement contract, the Contracting Authority may require the Contractor to confirm that the declaration submitted in this regard remains current. The Contractor is not subject to exclusion in the circumstances specified in Art. 108(1), points 1, 2 and 5 of the Pzp Act if it proves to the Contracting Authority that it has met the conditions indicated in Art. 110(2) of the Pzp Act. In a contract award procedure, where the value of the contract is equal to or exceeds the PLN equivalent of EUR 20,000,000 for construction works and EUR 10,000,000 for supplies or services, a contractor shall be excluded if it prevents or impedes the determination of the criminal origin of money or conceals its origin due to the inability to identify the beneficial owner within the meaning of Art. 2(2), point 1 of the Act of 1 March 2018 on Counteracting Money Laundering and Terrorist Financing (Journal of Laws of 2019, items 1115, 1520, 1655 and 1798) – Art. 108(2) of the Pzp Act. The Contracting Authority informs that it will examine and evaluate the tenders and then perform the qualification of the Contractor whose tender received the highest evaluation with respect to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. Therefore, Contractors shall not submit with their tenders the ESPD declaration referred to in Art. 125(1) of the Pzp Act. Before selecting the most advantageous tender, the Contracting Authority will call upon the Contractor whose tender received the highest evaluation to submit, within a prescribed period of no less than 10 days, the entity-related evidence specified in § X of the SWZ, valid as at the date of submission. The Contracting Authority does not require a performance bond.
