Opportunity description

The subject of the contract is the supply of cytostatics and medicinal products from drug programs (CPV: 33.69.00.00-3, 33.65.21.00-6) for the needs of Copernicus Podmiot Leczniczy Sp. z o.o. in Gdańsk, the detailed description, assortment and estimated quantities of which are contained in the Assortment and Price Form – Annex No. 1 to the SWZ (parts Nos. 1-235). The offered subject of the contract must be authorized for marketing and use in accordance with applicable law. The subject of the contract must comply with the Act of 7 April 2022 on medical devices (Journal of Laws 2022, item 974, as amended) and/or the Pharmaceutical Law Act of 6 September 2001 (Journal of Laws 2022, item 2301, as amended) – if applicable. In the case of an assortment specified using trade names, the Contracting Authority permits the submission of tenders for an assortment equivalent in every respect, i.e. composition, weight, range, spectrum and duration of action, form, function, etc., provided that it guarantees performance of the subject of the contract in accordance with the assumptions set out in this SWZ. In the case of an equivalent assortment, the Contractor is obliged to specify its trade name, catalogue number and the manufacturer's name. The burden of demonstrating the equivalence of the offered solution or equivalent solutions rests with the Contractor. In all provisions of the SWZ and its annexes in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems, or where trademarks, parameters or sources of origin (names of manufacturers or devices) are indicated, pursuant to Article 99(5) and Article 101(4) of the Pzp Act, the Contracting Authority permits equivalent solutions. The method of performing the subject of the contract is specified in the draft agreement contained in Annex No. 5 to the SWZ. The Contracting Authority does not reserve the possibility of applying for the contract exclusively to Contractors referred to in Article 94 of the Pzp Act. The Contracting Authority does not impose the requirements referred to in Article 96 of the Pzp Act. For the purpose of submitting a tender, the Contracting Authority does not envisage the Contractor conducting a site visit or inspecting documents necessary for the performance of the contract that are available at the Contracting Authority's premises. The Contracting Authority does not require the submission of subject-matter evidence with the tender. Contractors may apply for the award of the contract if they: Are not subject to exclusion, Meet the conditions for participation in the procedure concerning: capacity to conduct business activities – the Contracting Authority does not specify a detailed condition in this respect; authorization to conduct a specific business or professional activity, insofar as this results from separate regulations – the Contracting Authority will consider the condition fulfilled if the contractor submits a valid authorization to conduct the activity covered by the subject of the contract, i.e. an authorization to operate a pharmaceutical wholesaler or a manufacturing authorization if the contractor is a manufacturer, or, as appropriate, in the case of a contractor operating a consignment warehouse – an authorization to operate a warehouse that includes authorization to trade in medicinal products – if applicable; economic or financial standing – the Contracting Authority does not specify a detailed condition in this respect; technical or professional ability – the Contracting Authority does not specify a detailed condition in this respect. Contractors may apply for the award of the contract if they are not subject to exclusion from the procedure due to any of the circumstances indicated: a) in Article 108(1) of the Pzp Act, which occurred within the relevant period specified in Article 111 of the Pzp Act, b) in Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security, c) Article 5k(1) of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No. 833/2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (hereinafter: EU Council Regulation). The Contracting Authority does not provide for exclusion on the optional grounds for excluding a Contractor (Article 109(1) of the Pzp Act). The Contracting Authority may exclude a Contractor at any stage of the contract award procedure (Article 110(1) of the Pzp Act). In particular, for the purpose of implementing the prohibition referred to in Article 5k(1) of the EU Council Regulation, the Contracting Authority, before concluding the public procurement contract, may require the Contractor to confirm that the declaration submitted in this regard remains current. The Contractor is not subject to exclusion in the circumstances specified in Article 108(1), points 1, 2 and 5 of the Pzp Act if it proves to the Contracting Authority that it has fulfilled the conditions indicated in Article 110(2) of the Pzp Act. In a contract award procedure, in the case of a contract with a value equal to or exceeding the PLN equivalent of EUR 20,000,000 for construction works and EUR 10,000,000 for supplies or services, a contractor shall be excluded if it prevents or obstructs the determination of the criminal origin of money or conceals its origin due to the inability to determine the beneficial owner within the meaning of Article 2(2), point 1 of the Act of 1 March 2018 on counteracting money laundering and terrorist financing (Journal of Laws of 2019, items 1115, 1520, 1655 and 1798) – Article 108(2) of the Pzp Act. The Contracting Authority informs that it will examine and evaluate the tenders and then conduct the qualification of the Contractor whose tender received the highest evaluation with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. Accordingly, Contractors shall not submit with the tender the ESPD declaration referred to in Article 125(1) of the Pzp Act. Before selecting the most advantageous tender, the Contracting Authority will call upon the Contractor whose tender received the highest evaluation to submit, within a specified period of no less than 10 days, the entity-specific evidence specified in § X of the SWZ, current as at the date of submission. The Contracting Authority does not require a performance bond.
