Opportunity description

I. The subject matter of the contract is the supply of the medicinal products Asfotasum alfa and Onasemnogene abeparvovec under drug programmes. The Contracting Authority allows the submission of tenders for parts, divided into 2 parts. The Contracting Authority does not limit the number of parts of the contract for which Contractors may submit a tender. The Contracting Authority does not limit the number of parts of the contract that may be awarded to one Contractor. The Contracting Authority does not anticipate awarding contracts referred to in Article 214(1)(8) of the Public Procurement Law. Pursuant to Article 13(1) and (2) and Article 14(1) and (2) of Regulation (EU) 2016 /679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L of 2016 No. 119, p. 1) (“GDPR”), we would like to provide information about the rules governing the processing of personal data where the Contracting Authority processes your personal data in connection with conducting a public procurement procedure. 2. The controller of your personal data is the Contracting Authority. 3. You may contact the Contracting Authority regarding matters related to personal data protection: 1) by sending a letter to the address of its registered office or electronically by email to: dyr@imid.med.pl, or 2) via the ePUAP platform at: /IMiDWarszawa /SkrytkaESP. 4. The Contracting Authority has appointed a Data Protection Officer (“DPO”), whom you may contact regarding the processing of your personal data. The DPO may be contacted by email at: iod@imid.med.pl, by telephone at (22) 32 77 495, or in writing at the address of the Contracting Authority’s registered office. 5. The Contracting Authority processes your personal data for the following purposes: 1) conducting a public procurement procedure – pursuant to Article 6(1)(c) of the GDPR in conjunction with Article 9(2)(g) of the GDPR in conjunction with the provisions of the Public Procurement Law; 2) verification of information concerning the absence of criminal convictions as part of means of evidence relating to the entity – pursuant to Article 6(1)(c) in conjunction with Article 10 of the GDPR in conjunction with the provisions of the Public Procurement Law; 3) archiving personal data – pursuant to Article 6(1)(c) of the GDPR in conjunction with Article 9(2)(j) of the GDPR in conjunction with the Act on the National Archival Resources and Archives; 4) establishment, pursuit or defence of claims in connection with the activities conducted – pursuant to Article 6(1)(e) of the GDPR or Article 9(2)(f) of the GDPR, i.e. processing is necessary for the performance of tasks carried out in the public interest – proper management of the Contracting Authority’s property, i.e. conducting a valid public procurement procedure guaranteeing the proper expenditure of public funds.
