The Contracting Authority reserves the option to change the quantity of the product ordered within the quantities specified in individual items of a given part; changes may concern a decrease or increase in quantity within +/- 30%, provided that the total value of the given part (package) is not exceeded. The remaining conditions concerning performance of the contract have been specified in the Model contract – Annex No. 4 to the SWZ and the other annexes to the SWZ. II. Information on equivalent solutions: a) The Contracting Authority does not limit the subject matter of the contract to medicines listed by name. The Contracting Authority permits the submission of equivalent tenders – equivalent medicines/preparations, i.e. those having the same composition, dose and pharmaceutical form. In such an item, the appropriate trade name and the product’s EAN code (if it has one) must then be provided. b) Trade name – if a trade name of a product/company/goods appears in any annex to the SWZ, this means that the Contracting Authority was unable to define and describe the subject matter of the contract using sufficiently precise data, and it serves only to specify the desired standard of performance of the supply; c) If, in the description of the subject matter of the contract (annexes to the SWZ), the Contracting Authority specified the subject matter of the contract by indicating trademarks, patents or origin, source or a particular process that characterises the products or services supplied by a specific Contractor, where this could lead to certain Contractors or products being favoured or eliminated, it permits the submission of equivalent tenders. d) In situations where the Contracting Authority describes the subject matter of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Pzp Act, it permits solutions equivalent to those described. e) The above specification of the subject matter of the contract is solely auxiliary in the preparation of the tender and is intended to indicate the expected standards regarding the minimum technical parameters of the expected materials and equipment. f) An equivalent tender shall be understood as a tender with technical, strength, quality and performance parameters no worse than the description indicated by the Contracting Authority in the description of the subject matter of the contract. g) The parameters indicated by the Contracting Authority are minimum, threshold parameters. The term “parameters” means functionality, intended use, colour scheme, structure, materials, shape, size, safety, durability, etc. h) In view of the above, the Contracting Authority permits the option of offering materials with different trademarks, patents or origins, but not with properties and functionality different from those specified in the SWZ. i) Whenever a standard is indicated in this SWZ or the annexes to the SWZ, it shall be assumed that the phrase “or equivalent” has been used in relation to it. j) If the Contractor does not submit documents in its tender concerning the use of other materials and equipment, this shall be understood to mean that the materials and equipment proposed in the description of the subject matter of the contract have been included in the calculation of the tender price and in the performance of the contract. III. The indication of the supply completion date is justified by an objective reason: supplies will be made successively, the contract completion date was specified in order to maintain continuity of supply, and the completion of contracts on the same date for a given type of assortment is intended to maintain continuity of those contracts and also enables the timely performance of the Contracting Authority’s tasks. V. The Contracting Authority permits the submission of tenders for all parts of the contract, divided into individual Packages from 1 to 26 (none of the Packages may be subdivided). VI.
