The subject of the contract is the purchase, including delivery and carrying in, of office materials and supplies for units of the Silesian Police garrison. A detailed description of the subject of the contract (minimum parameters, minimum warranty period and estimated quantities) is provided in Annex No. 3 to the SWZ – the price form together with the description of the subject of the contract. The Contracting Authority may cancel the contract award procedure pursuant to Article 257 of the Act if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. Settlement will be based on successive deliveries actually completed according to the Contracting Authority's needs, at the offered gross unit prices, subject to § 7 of the draft contractual provisions. The subject of the contract is the purchase, including delivery and carrying in, of office materials and supplies for units of the Silesian Police garrison. The Contracting Authority does not consent to replacing the supplied assortment with an assortment other than that specified in Annex No. 3 to the SWZ (price form), with the proviso that the Contracting Authority consents to replacing the supplied assortment with an assortment other than that specified in the price form according to Annex No. 3 to the SWZ in cases where the Contractor demonstrates that the offered assortment has been withdrawn from sale or its production has been discontinued and it is unavailable on the Polish market (confirmed by the manufacturer or sales representative on the Polish market). The Contracting Authority permits another assortment to be offered and supplied, provided that its requirements continue to be met (which the Contracting Authority has the right to verify) before consent is given, the price is no higher than that offered in the price form, and the Contractor obtains the Contracting Authority's consent to change the offered assortment. The Contracting Authority requires the entire assortment to be brand-new, free from technical and legal defects, authorized for trade, first grade, and compliant with the quality and functional standards specified by the Contracting Authority in Annex No. 3 to the SWZ. The Contracting Authority requires the Contractor to specify the manufacturer, name, symbol or other data enabling unambiguous identification of the offered product in column 10 of Annex No. 3 to the SWZ, the price form. Where a product is required in several colors and the manufacturer assigns a specific symbol separately to each color, the Contractor is required to enter all of them in column No. 10. Failure to enter the manufacturer, name, symbol or other data enabling unambiguous identification of the offered assortment in the price form will result in rejection of the tender pursuant to Article 226(1)(5) of the Act as non-compliant with the contract conditions. The offered assortment should meet all requirements of the standards specified by applicable law. The Contracting Authority requires the Contractor to provide a minimum warranty for the offered assortment covered by the subject of the contract, i.e. 12 months, 24 months and 36 months from the date of delivery, in accordance with the requirements specified in column 2 for each item in the price form – Annex No. 3 to the SWZ. The Contracting Authority requires that, during the warranty period provided, all costs related to warranty service, including transport, be borne by the Contractor. Settlement will be based on successive deliveries actually completed according to the Contracting Authority's needs, at the offered gross unit prices, subject to § 7 of the draft contractual provisions. The value of the contract will amount to the sum that the Contracting Authority intends to allocate to finance the contract, i.e. the gross amount of PLN 2522202.88. The gross price calculated according to Section XVII of the SWZ must be provided for the purpose of selecting the most advantageous tender. If the price of the most advantageous tender exceeds the amount that the Contracting Authority intended to allocate for performance, the Contracting Authority will decide whether to conclude the contract up to the amount of the funds available, increase the funds allocated for performance, or cancel the procedure. The Contracting Authority permits subcontractors. If the Contractor uses subcontractors, the Contracting Authority requires the parts of the contract that it intends to entrust to them to be specified. Provisions concerning subcontractors are contained in Section XI of the SWZ and Annex No. 2 to the SWZ. The Contractor shall ensure the protection of transferred personal data in accordance with the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter RODO).
