Opportunity description

The procedure is conducted in accordance with the provisions of the Act of 11 September 2019 – Public Procurement Law (Journal of Laws of 2026, item 793), hereinafter referred to as the Pzp Act. The procedure is conducted as an open procedure pursuant to Article 132 of the Pzp Act. The Contracting Authority awards the contract in parts, each of which constitutes the subject of a separate procedure. The subject of the contract is the supply of fruit. Common Procurement Vocabulary (CPV) code: 03220000-9 Vegetables, fruit and nuts. A detailed description of the subject of the contract is set out in Annexes Nos. 1, 1.1., 5 and 4 to the SWZ, i.e.: Tender Form, Assortment and Price Specifications, Descriptions of the Subjects of the Contract, and Draft Contractual Provisions. The Contracting Authority does not permit the submission of partial tenders. Justification: The Contracting Authority does not permit the submission of partial tenders because the subject of the contract comprises successive supplies of fruit requiring continuity of supply, a uniform level of quality, and efficient organisation and coordination of contract performance. Dividing the contract into parts and entrusting their performance to several contractors could hinder the ongoing coordination of supplies, particularly with regard to the delivery dates, quantities and quality of the products supplied. If shortages or delays occur, or products need to be replaced, additional coordination of activities between the Contracting Authority and the individual Contractors would be necessary, which could adversely affect continuity of supply. Furthermore, supplies provided by different Contractors could involve differences in quality, freshness and the manner in which deliveries are carried out, making it difficult to ensure the uniform standards required by the Contracting Authority. Dividing the contract could also increase organisational and logistics costs associated, inter alia, with administering several contracts, coordinating multiple deliveries and monitoring their proper performance. In view of the above, the Contracting Authority considers that performance of the entire contract by a single Contractor will ensure more efficient organisation of deliveries, greater continuity and predictability of supply, and a uniform quality standard for the fruit supplied, as well as reduce the costs and risks associated with coordinating cooperation with multiple Contractors. The Contracting Authority requires a tender to be submitted for all required items listed in Annexes No. 1.1. to the SWZ. In this procedure, the Contracting Authority envisages awarding the basic (guaranteed) contract and possible orders under the Option Right. Information concerning the scope of the contract covered by the Option Right, including its scope, the deadline for the Contracting Authority to exercise this right, and the terms on which this will take place, is described in Annex No. 4 to the SWZ. The Option Right is a right of the Contracting Authority that it may, but is not required to, exercise under this procedure. The Contracting Authority bears no liability for failing to issue such a request to the Contractor, and the Contractor is not entitled to any claim on account of the Contracting Authority not exercising the Option Right. The circumstances for exercising the option are described in § 3 of Annex No. 4 to the SWZ. Whenever the subject of the contract in this SWZ is described by reference to trademarks, patents or origin, source or a particular process that characterises the products supplied by a specific Contractor, where this could lead to certain contractors or products being favoured or eliminated, such references shall be deemed to be accompanied by the words “or equivalent”. In describing the subject of the contract, pursuant to the provision expressed in Article 99(4) of the Pzp Act, the Contracting Authority referred to a trademark or origin due to the specific nature of the subject of the contract and the impossibility of describing it exhaustively using precise and comprehensible terms. By describing the subject of the contract using trademarks, patents or origin, source or a particular process that characterises the products supplied, the Contracting Authority thereby specifies the quality and technical parameters and performance characteristics with which the subject of the contract must comply in order to meet the requirements set by the Contracting Authority. The subject of the contract should comply with the technical, functional and quality parameters specified by the Contracting Authority in the description of the subject of the contract, constituting Annex No. 5 to the SWZ. The Contracting Authority does not reserve the possibility of applying for the award of the contract exclusively to Contractors referred to in Article 94(1) of the Pzp Act, i.e. those having the status of a sheltered workshop, social cooperatives and other Contractors whose main objective, or the main objective of the activities of their organisationally separate units that will perform the contract, is the social and professional integration of socially marginalised persons.
