The price must include all delivery costs, e.g. excise duty, customs duty, taxes, etc., transport, insurance until delivery to the place indicated by the Contracting Authority,.3. The vehicle together with the body must be made of brand-new materials. 4. The vehicle must be delivered to the registered office of Przedsiębiorstwo Gospodarki Komunalnej Sp. z o.o., ul. Komunalna 5, 75-724 Koszalin between 7.00 and 14.00 from Monday to Friday, except for statutory public holidays, after notifying the Contracting Authority at least 3 working days before delivery. 5. The delivered vehicle must have the appropriate documents allowing it to be registered with the competent authorities. 6. The delivered lift must have the appropriate technical documents, including a UDT decision.II. Technical parameters of the vehicle – chassis.1. Brand-new.2. The evidence relating to the subject matter of the contract consists of information on the offered subject matter of the contract - a vehicle with a permissible gross weight of up to 12 Mg with a lift. 2. Together with the “Tender Form”, the Contractor shall submit completed Appendix No. 2 to Chapter I of the SWZ – “Information on the offered subject matter of the contract”.3. If Appendix No. 2 to Chapter I of the SWZ – “Information on the offered subject matter of the contract” is not submitted or individual information is missing from it, the Contracting Authority provides for the submission or supplementation of this document within a specified deadline.1) The Contracting Authority provides for the possibility of applying the procedure specified in the provision of Art. 139 para. 1 of the PZP Act, the so-called “reverse procedure”. 2) Pursuant to Art. 20 para. 2 of the PZP Act, the public procurement procedure shall be conducted in Polish. 3) The Contracting Authority does not provide for the award of contracts referred to in Art. 214 para. 1 point 8 of the PZP Act. 4) The Contracting Authority does not permit the submission of a tender providing for a method of performing the contract different from that specified in the SWZ (variant tender). 5) The Contracting Authority does not divide the contract into lots. Therefore, the Contracting Authority does not permit the submission of partial tenders referred to in Art. 7 point 15 of the PZP Act. Reasons for not dividing the contract: The contract cannot be divided into lots due to the type of contract. The subject matter of the contract is the supply of 1 vehicle with a permissible gross weight of up to 12 Mg with a lift, 6) Pursuant to Art. 95 para. 1 of the PZP Act, the Contracting Authority does not require the Contractor or Subcontractor to employ, under an employment contract in the manner specified in Art. 22 § 1 of the Act of 26 June 1974 - Labour Code (consolidated text: Journal of Laws of 2023, item 1465, of 2024, items 878, 1222, of 2025, item 277 ), persons performing activities during the performance of the contract.8) The Contracting Authority awards the contract in parts, each of which constitutes the subject matter of a separate public procurement procedure, The Contractor must attach to the tender the statement referred to in Art. 125 para. 1 of the PZP Act, i.e. a STATEMENT concerning the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure, within the scope indicated in Chapter I point 5 of the SWZ, submitted on the European Single Procurement Document (ESPD) form, according to the template specified by the Contracting Authority in Chapter III of the SWZ point 1. The ESPD constitutes evidence confirming the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure as at the tender submission date, temporarily replacing the qualification evidence required by the Contracting Authority, indicated in Chapter I point 6.1 of the SWZ.In addition, the Contractor must attach to the tender a statement constituting evidence confirming, as at the tender submission date, the absence of grounds for exclusion pursuant to Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU No L 229 of 31.7.2014, p.1), as amended by Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU No L 111 of 8.4.2022, p.1) and subsequent amendments, according to the template specified in Chapter III of the SWZ point 2 , Statements shall be submitted, failing which they shall be null and void, in electronic form,6. FOREIGN CONTRACTORS. 1) If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of: 1.1) Information from the National Criminal Register referred to in Chapter I point 6.1 subpoint 3.1 of the SWZ – it shall submit information from the relevant register, such as a court register, or, if there is no such register, another equivalent document issued by the competent judicial or administrative authority of the country in which the Contractor has its registered office or place of residence or in which the person to whom the information or document relates has their place of residence, within the scope referred to in Chapter I point 6.1 subpoint 3.1 of the SWZ; 1.2) A copy of or Information from the National Court Register or from the Central Register and Information on Economic Activity, referred to in Chapter I point 6.1 subpoint 3.3 of the SWZ – it shall submit a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming that its liquidation has not been opened, bankruptcy has not been declared, its assets are not managed by a liquidator or court, it has not entered into an arrangement with creditors, its business activity has not been suspended and it is not in any other situation of this kind resulting from a similar procedure provided for in the laws of the place where that procedure was initiated.2) The document referred to in subpoint 1.1 should have been issued no earlier than 6 months before its submission. The document referred to in point 1.2 should have been issued no earlier than 3 months before its submission. 3) If, in the country in which the Contractor has its registered office or place of residence or in which the person to whom the document relates has their place of residence, the documents referred to in subpoint 1 are not issued, or if those documents do not refer to all the cases referred to in Art. 108 para. 1 points 1, 2 and 4 of the PZP Act, they shall be replaced, as appropriate, in whole or in part by a document containing, as appropriate, a statement by the Contractor, indicating the person or persons authorised to represent it, or a statement by the person to whom the document was to relate, made under oath, or, if the country in which the Contractor has its registered office or place of residence or in which the person to whom the document was to relate has their place of residence has no provisions concerning statements under oath, Procedure: open.
