Opportunity description

1. The subject of the contract is successive supplies of disposable products of the types and in the quantities specified in the price form constituting Appendix No. 2 to the SWZ and in accordance with the draft contractual provisions constituting Appendix No. 4 to this SWZ, i.e. by tasks as follows: Task 1: Supplies of brushes for gynecological swabs Task 2: Supplies of gastrostomy tubes Task 3: Supplies of urinary catheters Task 4: Supplies of clamps for stabilizing the skull flap Task 5: Supplies of tonsil snares Task 6: Supplies of Crawford-type intubation sets. Task 7: Supplies of intravenous infusion cannulas Task 8: Supplies of specialized intubation tubes Task 9: Supplies of pump irrigation tubing. Task 10: Supplies of anesthesiology accessories Task 11: Supplies of jejunostomy sets, clamps and adapters Task 12: Supplies of nitrile gloves Task 13: Supplies of biopsy and grasping forceps Task 14: Supplies of Veress needles Task 15: Supplies of titanium vascular clips for the Horizon clip applier Task 16: Supplies of skin markers Task 17: Supplies of ostomy bags. Task 18: Supplies of aluminum nasal stabilizers Task 19: Supplies of suction handles and tubes Task 20: Supplies of laparoscopic bags Task 21: Supplies of endobronchial intubation tubes Task 22: Supplies of synthetic cyanoacrylate adhesive Task 23: Supplies of bags for preparing parenteral nutrition mixtures Task 24: Supplies of laparoscopic pouches for tissue specimens Task 25: Supplies of urinals Task 26: Supplies of bowls for patient care Task 27: Supplies of deep bedpans, covers for deep bedpans and plastic supports for deep bedpans Task 28: Supplies of shallow bedpans, covers for shallow bedpans and plastic supports for shallow bedpans 2. The Contracting Authority guarantees that the minimum value of orders awarded to the Contractor during the term of the contract under the basic scope will amount to 70% of the Contractor’s remuneration for the given task under the basic scope, specified in the Price Form constituting Appendix No. 1 to the contract – the underlined provision applies to tasks 5,6,7. 3. The Contracting Authority is entitled to exercise the option right specified in Article 441 of the Public Procurement Law (hereinafter: “option right”), i.e.: a quantity option consisting in the possibility of increasing the quantity of goods covered by the subject of the contract relative to the quantities specified in Appendix No. 1 to the contract (price form), in the column “Quantity, pcs. (basic scope),” by no more than the quantities specified in Appendix No. 1 to the contract (price form), in the column “Quantity, pcs. (option right)” – applies to tasks No. 5,6,7. The Contracting Authority advises that, in these proceedings conducted under the open tender procedure, it envisages the possibility of applying the procedure referred to in Article 139(1) of the PPL Act. When applying the aforementioned procedure, the Contracting Authority will first examine and evaluate the tenders and will then conduct the subjective qualification of the Contractor whose tender was rated highest with respect to the absence of grounds for exclusion and fulfillment of the conditions for participation in the proceedings. The Contractor is obliged to provide the bid security for the entire tender validity period specified in this SWZ. 3. The tender of a Contractor who fails to provide bid security, provides it incorrectly, fails to maintain the bid security continuously until the expiry of the tender validity period, or submits a request for the return of the bid security in the case referred to in Article 98(2)(3) of the PPL Act, will be rejected pursuant to Article 226(1)(14) of the Act. 4. Bid security may be provided in one or more of the following forms: a) money; b) bank guarantees; c) insurance guarantees; d) sureties granted by the entities referred to in Article 6b(5)(2) of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2025, item 98). 5. If bid security is provided in the form specified in paragraph 4, points 2-4 of the SWZ, its content should provide for the Guarantor’s unconditional and irrevocable obligation, payable upon the first written demand submitted by the Contracting Authority (during the tender validity period), to pay the Contracting Authority the full amount of the bid security in the circumstances specified in Article 98(6) of the Act. 6. Bid security provided in money must be paid by bank transfer to the Contracting Authority’s bank account: Bank Millennium S.A. Bid security in money is effectively provided when the funds are credited to the aforementioned bank account of the Contracting Authority before the deadline for submission of tenders (i.e. before the
