Opportunity description

1. The subject of the contract is the construction and equipping of one production exploratory-production borehole OI-1 on cadastral plot No. 249/2 in Święcice, Ożarów Mazowiecki municipality 2. A detailed description of the scope of the subject of the contract is contained in the Description of the subject of the contract – Appendix No. 1 to the SWZ, which consists of: 1) Geological works design, 2) Technical specification for the execution and acceptance of construction works 3) Bill of quantities The Contractor is obliged to verify the bill of quantities (it constitutes supporting material only). The documentation referred to in point 4.4.1) and point 4.4.2) of the SWZ takes precedence over the bill of quantities. The tender must be prepared on the basis of the attached documentation. The bill of quantities does not constitute the basis for calculating the final tender price in the tender 3. The scope of the subject of the contract also includes. 1) surveying services to the extent necessary to perform the subject of the contract, 2) preparation of as-built surveying documentation, 3) obtaining an occupancy permit and handing over the completed facility to the Contracting Authority for use, together with documentation containing attestations, approvals or certificates necessary to commence operation, 4) as well as all elements listed in any part of the documents comprising Appendix No. 1 to these Terms of Reference (SWZ) and affecting the tender price of the subject of the contract 4. The Contracting Authority does not hold a water-law permit. The Contractor’s obligations will include preparing all documentation authorizing the commissioning of the intake and the abstraction of water 5. The Contracting Authority anticipates the possibility of substitute works and the conditions under which these changes may be introduced for technological or economic reasons, if the introduction of substitute works is necessary for the proper performance of the contract and does not extend the subject of the contract in relation to the subject specified in the SWZ and resulting from the content of the SWZ The conditions concerning the scope of substitute works and the method of settling them are described in § 15 of the draft contract. The Contracting Authority will inform the Contractor of all changes during the performance of the contract. The performance of substitute works requires an amendment to the contract in the form of an annex to the contract, as specified in Art. 455 of the Pzp Act 6. Pursuant to Art. 95 of the Pzp Act, the Contracting Authority requires the Contractor or Subcontractor to employ, on the basis of an employment relationship, persons performing the activities indicated by the Contracting Authority within the scope of contract performance, if the performance of those activities consists in performing work in the manner specified in Art. 22 § 1 of the Act of 26 June 1974, the Labour Code (Journal of Laws of 2025, item 277, as amended). The requirements for employment by the Contractor or Subcontractor on the basis of an employment relationship concern persons directly performing construction works at the construction site, i.e. manual workers and lower-level technical staff responsible for organizing and carrying out construction works. These requirements do not apply to the construction manager, works managers or persons providing services at the construction site as part of their own business activity using their own equipment or tools, such as measurement and testing work, demolition and earthworks, and the delivery of excavated material or transport of construction materials, etc. The method of verifying employment, as well as the Contracting Authority’s powers to inspect the Contractor’s compliance with employment-related requirements and the sanctions for failure to meet these requirements, are specified in the draft contract constituting Appendix No. 2 to the SWZ 1.
