Supply in the form of an operating lease with an option to purchase a factory-new front-end loader from serial production, with a bucket capacity of min. 4.0m3, engine power of min. 170kW and an unladen loader weight from 18Mg to 20Mg. A detailed description of the subject matter of the contract is set out in Chapter II of the SWZ. The Contracting Authority permits the use of a machine with a power of 158 kW (172 Hp gross). 1) The Contracting Authority provides for the possibility of applying the procedure specified in the provision of Art. 139(1) of the PZP Act, the so-called “reverse procedure”. 2) Pursuant to Art. 20(2) of the PZP Act, the contract award procedure shall be conducted in Polish. 3) The Contracting Authority does not provide for the award of contracts referred to in Art. 214(1)(8) of the PZP Act. 4) The Contracting Authority does not permit the submission of a tender providing for a method of performing the contract different from that specified in the SWZ (variant tender). 5) The Contracting Authority does not divide the contract into lots. Thus, the Contracting Authority does not permit the submission of tenders for individual lots referred to in Art. 7(15) of the PZP Act. Reasons for not dividing the contract: The contract cannot be divided into lots due to the type of contract. The subject matter of the contract is the supply of a wheeled loader with attachments to the Regional Waste Recovery Plant in Sianów in the form of an operating lease, 6) The Contracting Authority does not require, pursuant to Art. 95(1) of the PZP Act, the employment by the Contractor or Subcontractor under an employment contract, in the manner specified in Art. 22 § 1 of the Act of 26 June 1974 – Labour Code (consolidated text: Journal of Laws of 2023, item 1465, of 2024, items 878, 1222, of 2025, item 277), of persons performing activities during the performance of the contract. The Contractor must attach to the tender the declaration referred to in Art. 125(1) of the PZP Act, i.e. a DECLARATION of not being subject to exclusion and of meeting the conditions for participation in the procedure, within the scope indicated in Chapter I point 5 of the SWZ, submitted on the European Single Procurement Document (ESPD) form, according to the template specified by the Contracting Authority in Chapter III point 1 of the SWZ. The ESPD constitutes evidence confirming the absence of grounds for exclusion and compliance with the conditions for participation in the procedure as at the tender submission date, temporarily replacing the entity-related means of evidence required by the Contracting Authority, indicated in Chapter I point 6.1 of the SWZ. The Contractor must attach to the tender the declaration referred to in Art. 125(1) of the PZP Act, i.e. a DECLARATION of not being subject to exclusion and of meeting the conditions for participation in the procedure, within the scope indicated in Chapter I point 5 of the SWZ, submitted on the European Single Procurement Document (ESPD) form, according to the template specified by the Contracting Authority in Chapter III point 1 of the SWZ. The ESPD constitutes evidence confirming the absence of grounds for exclusion and compliance with the conditions for participation in the procedure as at the tender submission date, temporarily replacing the entity-related means of evidence required by the Contracting Authority, indicated in Chapter I point 6.1 of the SWZ. SUBJECT-MATTER MEANS OF EVIDENCE – to confirm the compliance of the offered supply with the requirements specified in Chapter II of the SWZ – Detailed description of the subject matter of the contract, the Contracting Authority requires the submission together with the tender of the following subject-matter means of evidence: 1. The subject-matter means of evidence consists of information on the offered subject matter of the contract (a wheeled loader with attachments for the Regional Waste Recovery Plant in Sianów in the form of an operating lease). 2. Together with the “Tender form”, the Contractor shall submit completed Annex No. 2 to Chapter I of the SWZ – “Information on the offered subject matter of the contract”.3. If Annex No. 2 to Chapter I of the SWZ – “Information on the offered subject matter of the contract” is not submitted or individual information is missing, the Contracting Authority provides for the submission or supplementation of this document within the specified time limit.7. FOREIGN CONTRACTORS. 1) If the Contractor has its registered office or place of residence outside the borders of the Republic of Poland, instead of: 1.1) Information from the National Criminal Register referred to in Chapter I point 6.1 subpoint 3.1 of the SWZ – it shall submit information from the relevant register, such as a court register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the Contractor has its registered office or place of residence or in which the person concerned by the information or document has their place of residence, within the scope referred to in Chapter I point 6.1 subpoint 3.1 of the SWZ; 1.2) A copy or Information from the National Court Register or from the Central Register and Information on Economic Activity referred to in Chapter I point 6.1 subpoint 3.3 of the SWZ – it shall submit a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming that its liquidation has not been opened, bankruptcy has not been declared, its assets are not managed by a liquidator or a court, it has not entered into an arrangement with creditors, its business activity is not suspended and it is not in any other similar situation resulting from a similar procedure provided for in the laws of the place where that procedure was initiated.2) The document referred to in subpoint 1.1 should be issued no earlier than 6 months before its submission. The document referred to in point 1.2 should be issued no earlier than 3 months before its submission. 3) If, in the country in which the Contractor has its registered office or place of residence or in which the person concerned by the document has their place of residence, the documents referred to in subpoint 1 are not issued, or where those documents do not relate to all the cases referred to in Art. 108(1)(1), (2) and (4) of the PZP Act, they shall be replaced, as appropriate, in whole or in part by a document containing, as appropriate, a declaration by the Contractor, indicating the person or persons authorised to represent it, or a declaration by the person whom the document was intended to concern, made under oath, or, if in the country in which the Contractor has its registered office or place of residence or in which the person whom the document was intended to concern has their place of residence there are no provisions on declarations under oath, made before a judicial or administrative authority, a notary, or a professional or economic self-government body competent with regard to the registered office or place of residence of the Contractor or the place of residence of the person whom the document was intended to concern.
