Preparation of complete design documentation and, on its basis, execution of construction works for the investment project entitled: “Reconstruction and construction of the Athletics Stadium – athletics and football complex”. Contractors with respect to whom any of the circumstances indicated in the following provisions apply shall be excluded from the contract award procedure: 1) Article 108(1) and Article 109(1)(7), (8) and (10) of the Public Procurement Law; 2) Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and protecting national security. The Contractor shall be excluded for the duration of the circumstances specified in the aforementioned Article 7(1), and I am not subject to exclusion from the procedure under Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU L 229, 31.7.2014, p. 1), hereinafter: Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU L 111, 8.4.2022, p. 1), hereinafter: Regulation 2022/576. 3. Contractors may apply for the award of the contract if they meet the conditions concerning: economic or financial standing: a) The Contracting Authority shall consider that the Contractor has an economic or financial standing ensuring proper performance of the contract if the Contractor demonstrates that it has financial resources or creditworthiness of no less than PLN 25,000,000 (twenty-five million zlotys); Where a joint tender is submitted, the aforementioned condition may be met jointly by the Contractors, provided that at least one of the Contractors jointly applying for the award of the contract has financial resources or creditworthiness of no less than PLN 15,000,000 (fifteen million zlotys). Technical or professional ability: a) The Contractor shall meet the condition if it demonstrates that it has/will have at least 1 person who will participate in the performance of the contract in the position of lead architect, holding valid, unrestricted design qualifications in the architectural discipline, who has prepared, within the last 4 years, at least 2 sets of design documentation for an athletics stadium agreed upon and approved by PZLA. b) The Contractor shall meet the condition if it demonstrates that it has/will have at least 1 person who will participate in the performance of the contract in the position of construction manager, holding valid, unrestricted construction qualifications to manage construction works in the structural and construction discipline, who has at least 5 years of experience in performing independent technical functions in construction and served as construction manager on at least 2 constructions of an athletics, football, or athletics and football stadium, each with a value of at least PLN 10,000,000.00. c) The Contractor shall meet the condition if it demonstrates that it has/will have at least 1 person who will participate in the performance of the contract in the position of works manager, holding valid, unrestricted construction qualifications to manage construction works in the installation discipline in the field of heating, ventilation, gas, water supply and sewerage networks, installations and equipment, who has at least 6 years of experience in performing independent technical functions in construction and served as construction manager or works manager on at least 2 constructions of public-use buildings, each with a usable floor area of at least 1,000 m2. d) The Contractor shall meet the condition if it demonstrates that it has/will have at least 1 person who will participate in the performance of the contract in the position of works manager, holding valid, unrestricted construction qualifications to manage construction works in the installation discipline in the field of electrical and power networks and equipment installations, who has at least 6 years of experience in performing independent technical functions in construction and served as construction manager or works manager on at least 2 constructions of an athletics, football, or athletics and football stadium. e) The Contractor shall meet the condition if it demonstrates that, during the last 10 years before the deadline for submission of tenders, or, if the period of business activity is shorter, during that period, it duly completed at least 1 construction work involving the construction/reconstruction or modernisation of a sports stadium, with a value of at least PLN 13,000,000.00, at which an athletics track (min. 4 lanes, 800 m) was constructed and a PZLA certificate of at least category IV was obtained. f) The Contractor shall meet the condition if it demonstrates that, during the last 10 years before the deadline for submission of tenders, or, if the period of business activity is shorter, during that period, it duly completed at least 1 construction work involving the construction/reconstruction or modernisation of a sports stadium meeting the requirements necessary for play in at least the fourth league in accordance with the requirements imposed by the Polish Football Association (PZPN), with a value of at least PLN 15,000,000.00 gross. g) The Contractor shall meet the condition if it demonstrates that, during the last 5 years before the deadline for submission of tenders, or, if the period of business activity is shorter, during that period, it duly completed at least 2 construction works involving the construction/reconstruction or modernisation of buildings, each with a value of at least PLN 20,000,000.00 gross. Each of the conditions described in points e)–g) may be met separately (the experience of another entity may concern all or selected conditions). Reliance on part of the experience described in each of points e)–g) (aggregation of experience within one point) is not permitted. Preparation of complete design documentation and, on its basis, execution of construction works for the investment project entitled: “Reconstruction and construction of the Athletics Stadium – athletics and football complex”. 1. As part of the scope of work, the Contractor shall: 1) prepare complete design documentation based on the Functional and Utility Programme and the documents listed in point 3.2.; furthermore: a) provide author’s supervision over the execution of the construction works; b) agree the design documentation with PZLA and PZPN in accordance with the approvals of the documentation attached to the tender procedure. 2) carry out all activities related to the execution of the construction works, taking into account the division of the performance of the subject matter of the contract into individual stages, in particular: a) construction works involving the demolition of the facility’s existing infrastructure, site preparation, construction of an athletics and football stadium (including a stand, sports hall, hotel, and athletics and football infrastructure), together with accompanying infrastructure and technological installations and equipment; b) internal roads, car parks and pavements, street furniture, lighting and landscaping; c) supply and installation of equipment and furniture for the facilities, together with sports equipment; d) commissioning of all equipment in accordance with the approved design documentation; e) provide PZPN and PZLA consultancy during the construction works; f) all elements of sports and accompanying infrastructure necessary for the facility to function in accordance with applicable regulations and for acceptance of the facility by PZLA and PZPN. 3) prepare as-built documentation; 4) obtain certification of the facility by PZLA and PZPN; 5) transfer to the Contracting Authority the economic copyrights to the design documentation and the as-built documentation, under the conditions specified in the contract; 6) provide a guarantee and statutory warranty and ensure free servicing and maintenance with respect to the completed construction works, under the conditions specified in the contract; 7) provide a guarantee for the accompanying infrastructure under the conditions specified by the manufacturer. 2. The description of the subject matter of the contract is specified by: 1) the Functional and Utility Programme and the Architectural Concept; 2) approvals of the concept by PZPN and PZLA; 3) utility demand balance; 4) Greenery – study; 5) maps; 6) site geology. 3. The subject matter of the contract shall be performed in accordance with the principles of technical knowledge and good construction practice, applicable provisions and standards, and under the conditions agreed with the Contractor pursuant to the contract. 4. The Contracting Authority does not provide for additional remuneration in connection with author’s supervision and any obligations arising therefrom during performance of the contract. The Contractor is required to attend a site visit. The tender of a Contractor that does not attend a site visit shall be rejected. The Contracting Authority stipulates that the final date for conducting the site visit may not fall within the week preceding the deadline for submission of tenders. Procedure: open.
