Framework agreement for the supply of a MEDICAL ANGIOGRAPH in accordance with the attached technical specifications. Economic operators interested in the procedure shall request clarifications or additional information regarding the procurement documentation 18 days before the deadline established for the submission of tenders, and pursuant to Article 161 of Law 98/2016, amended by Emergency Ordinance 107/2017, the contracting authority’s response will be transmitted 10 days before the deadline established for the submission of tenders. SUSPENSIVE CLAUSE: The procedure for awarding the public procurement framework agreement, respectively the conclusion of the subsequent supply contract, is initiated subject to this SUSPENSIVE CLAUSE, in the sense that the conclusion of the public procurement contract is conditional upon the allocation of budget appropriations for this purpose, and the contract shall be signed in compliance with the provisions concerning the commitment of expenditure from budgets that fall under the legislation governing public finances. Having regard to the provisions of Law 98/2016 on public procurement and Government Decision No. 395/2016, as subsequently amended and supplemented, the Contracting Authority specifies that it will conclude the contract with the tenderer declared the winner only insofar as the funds required for the procurement are secured through the allocation of budget appropriations for this purpose. If, regardless of the reasons, the budget appropriations are not allocated for a period of 3 years from the date of conclusion of the framework agreement, the award procedure shall be cancelled by operation of law, provided that there is no other source of financing, in accordance with the provisions of Article 212(1)(c), second sentence, of Law 98/2016, as subsequently amended and supplemented, making it impossible to conclude the public procurement contract. Tenderers participating in this procedure understand that the Contracting Authority cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority was notified of the existence of such damage. Tenderers participating in this procedure accept the use of the above special conditions/suspensive clause, assuming full liability in relation to any damage they might suffer in the situation described. The maximum period during which the suspensive clause applies is 3 years, so that if the condition concerning the allocation of funds is not fulfilled, the award procedure is cancelled.” The angiograph intended for the Rhythmology Department within the “Niculae Stăncioiu” Emergency Heart Institute for Cardiovascular Diseases contributes to developing the healthcare facility’s capacity to provide specialized medical services adapted to patients’ needs and current requirements in the medical field. The need for the procurement is determined by the need to ensure and develop the capacity for the interventional diagnosis and treatment of patients with cardiovascular conditions through the use of modern, high-performance technology.
