Romania – Antivirals for systemic use – OPEN TENDER - FRAMEWORK AGREEMENT FOR THE SUPPLY OF MEDICINAL PRODUCTS FOR HUMAN USE HIV/AIDS 2024-2026

Opportunity description

Bucharest Jilava Prison Hospital runs the National HIV/AIDS Prevention and Surveillance Program for the entire prison system, and until the completion of the award procedure and the provision of the centralized framework agreements by the Ministry of Health, our unit runs its own award procedure and awards subsequent contracts based on the framework agreements concluded by it. After completion of the award procedure at centralized level, Bucharest Jilava Prison Hospital will award subsequent contracts based on the framework agreements made available by the Ministry of Health, for the lots awarded by the centralizing unit. The contracting authority will conclude framework agreements for the supply of medicinal products for human use with a maximum of 3 economic operators, without reopening competition. The subsequent contracts related to the framework agreements will generally be concluded quarterly depending on the available budgetary appropriations, and payment will be made into a Treasury account by payment order within 60 days. The first subsequent contract will be concluded only after the expiry of the framework agreements in force or after the maximum quantities provided for therein have been used up, as applicable. The first subsequent contract and the following subsequent contracts will be concluded having regard to Article 118(1)(a) of Law 98/2016 with the winning tenderer of the framework agreement. If the tenderer ranked first is unable to conclude a new subsequent contract for justified reasons, the contracting authority reserves the right to purchase from the tenderer ranked second or third in the framework agreement, respectively. The products are divided into lots with estimated minimum and maximum quantities according to the calculation basis and Annex No. 1 to the procurement documentation. Delivery of the products under the subsequent contracts will be made only on the basis of an order. Orders will be sent by the contracting authority by fax or e-mail, and delivery will be made periodically during the time interval established by mutual agreement. The procedure will be completed by signing a framework agreement/framework agreements for each lot per winner.
