PURCHASE OF AB31.5 TYPE ASPHALT MIXTURE WITH TRANSPORT INCLUDED for DRDP Cluj - 2-YEAR Framework Agreement. Maximum estimated value of the framework agreement for 2 years: The maximum value of the framework agreement is 9,840,000 lei excluding VAT. The minimum value of the framework agreement is 205,000.00 lei excluding VAT. Value of the largest subsequent contract: 1,845,000.00 lei excluding VAT. The minimum and maximum quantities of the framework agreement and of the subsequent contracts are in accordance with the annexes to the Tender Specifications. Subsequent contracts (min. 1 - max. 4) will be concluded per year depending on the funds allocated. The contracting authority reserves the right to modify the contract pursuant to Art. 221 of Law 98/2016, provided that these modifications do not fall under the provisions of Art. 221 para. 7 of Law 98/2016, i.e. they do not constitute a substantial modification. Revision clauses pursuant to Art. 221 para. (1) letter a) of Law No. 98/2016, which anticipate possible modifications that may occur during the performance of the contract, are as follows: 1. Parties to the framework agreement / Contracting parties; 2. Unit price of the products. Adjustment by updating the prices of the Framework Agreement / Price of the subsequent contract – Adjustment of unit prices; 3. Duration of the contract 4. Subcontractors.Third parties 5. Payment methods and recovery of claims 6. Inspections/testing/checks in accordance with the provision in the framework agreement and subsequent contract - template. This framework agreement does not constitute the legal basis for committing public funds. On the basis of this framework agreement, subsequent contracts will be awarded, which constitute the legal basis for payment. Subsequent contracts will be awarded according to the needs of DRDP CLUJ. The number and duration of the contracts will be established according to the budgetary funds that can be allocated for this purpose. Deadlines for submitting/responding to requests for clarifications/additional information: A.In accordance with the provisions of Art. 160 para. (1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which any interested economic operator has the right to request clarifications or additional information regarding the procurement documentation is no more than 18 days before the deadline for submission of tenders. B. In accordance with the provisions of Art. 161 para. (1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which the contracting authority will respond clearly and completely to all requests for clarification/additional information is the 11th day before the deadline established for submission of tenders. *Any request for clarification submitted after the date mentioned under point A) will make it impossible for the contracting authority to provide a response within the deadline mentioned under point B), and consequently any request for clarification within the deadlines mentioned will be considered late. The purchase of AB 31.5 asphalt mixture with transport included is sought for the national roads under the administration of DRDP Cluj. Frequency and value of subsequent contracts to be awarded: minimum 1 subsequent contract per year and maximum 4 per year. The minimum and maximum quantities relating to the framework agreement, as well as the estimated minimum and maximum quantities relating to a subsequent contract, are included as annexes to the procurement documentation / tender specifications.
