Orderliness and cleaning services in service areas, car parks and CICs on the A2 and A4 motorways - 4-YEAR FRAMEWORK AGREEMENT. Maximum framework agreement value: 34.018.914,96 lei. Minimum framework agreement value: 30.833.594,88 lei excluding VAT Value of the largest subsequent contract: 8.518.792,14 lei excluding VAT Value of the smallest subsequent contract: 7.703.710,92 lei excluding VAT Frequency and value of the contracts to be awarded: minimum 1 subsequent contract in each year of the framework agreement. The minimum and maximum quantities relating to the framework agreement, as well as the estimated minimum and maximum quantities relating to a subsequent contract, are included as Annexes to the award documentation/specifications. A)Number of days before the deadline for submission of tenders/applications by which clarifications may be requested: 20 days. B)In accordance with the obligation provided for in Article 160(2) of Law 98/2016, as amended and supplemented, the contracting authority will respond clearly and specifically to all requests for clarification on the 11th day before the deadline established for the submission of tenders. Any request for clarification submitted after the date mentioned in point A) will make it impossible for the contracting authority to provide a response within the time limit mentioned in point B), and consequently any request for clarification within the mentioned time limits will be considered late. The framework agreement is concluded with the following suspensive clause:,,The framework agreement may terminate before the completion of the 4 years if the 22 service areas and/or the 4 CICs on the A2 motorway section km 64+000 – km 211+980 and A4 km 0+000 – 21+760 are concessioned in accordance with the CNAIR Strategy for the integration of the national network into the Trans-European Transport Network (TEN-T)’’ Orderliness, cleaning and maintenance services in service areas, car parks and CICs on the A2 and A4 motorways. Ensuring orderliness, cleanliness and maintenance in the 26 service areas and CICs on the A2 Motorway, Lehliu-Cernavodă Sector, km 64+000 – km 211+980, and A4, Ovidiu-Agigea Sector, km 0+000 – 21+760, for a period of 4 years, on a permanent 24 hours/day basis, consisting of: - ensuring and maintaining the integrity and functionality of the car parks and sanitary facilities (water supply installations, wastewater drainage, sanitary and heating installations); - care of green spaces in the car parks; - periodic emptying of the septic tanks associated with the sanitary facilities(as often as necessary); - ensuring the selective collection of waste from the car parks, separately for paper, plastic, glass and household waste; - removal of household, biodegradable and selectively collected waste; - transport of waste to a storage facility, in accordance with the legislation in force; - Permanent communication with the Motorway Administration, access to emergency telephone numbers (ambulance, firefighters, I.S.U, D.R.D.P. Constanța) The contracting authority reserves the right to modify the contract pursuant to Article 221 of Law 98/2016, as amended and supplemented, provided that these modifications do not fall under the provisions of Article 221(7) of Law 98/2016, as amended and supplemented, i.e. they do not constitute substantial modifications. Subject of the modifications:1.Modifications to the duration of service provision;2.Modifications to the number of service areas, CICs and/or car parks where the cleaning service is performed;3.Modifications to the quantities of materials/products and modifications to the quantities of services estimated to be performed for the provision of the cleaning service;4.Modifications generated by central/local authorities, required through various approvals/agreements/authorisations;5. Modifications generated by the inclusion of new subcontractors and/or replacement of the initial subcontractors. Reason for the modifications:- various requirements of the contracting authority-if applicable; -modification of certain quantities of services/products in the specifications;- extension of the duration of service provision;-omission of certain services from the specifications; Limits of the modifications: -In accordance with the legal provisions in force; Purpose of the modifications:To avoid blocking the provision of services and the fulfilment of the subject matter of the contract. Proposed mechanism for implementing any modifications:In accordance with the legal contractual provisions.
