Opportunity description

Framework agreement for the supply of Products of animal origin, meat, meat products, fish and fish products, divided into 8 lots, necessary to provide food for institutionalized beneficiaries within the social services subordinated to DGASPC Botoșani, during the period 01.08.2026 - 31.07.2028. The products will be delivered to the premises of the social services distributed throughout Botosani County, in the quantities, technical characteristics and conditions requested through the specifications. The purpose of the open tender is to conclude a framework agreement for the period 01.08.2026 - 31.07.2028. 3 (three) subsequent contracts will be concluded at an interval of 8 (eight) months, with the reopening of competition in SEAP among the EOs that are signatories to the framework agreement, pursuant to Art. 118 point b/Law 98/2016, as amended, and Art. 110 of Government Decision 395/2016, as updated, as follows: S.C. 1 - 01.08.2026 - 31.03.2027, SC 2 - 01.04.2027 - 30.11.2027, SC 3 - 01.12.2027 - 31.07.2028, depending on the existence of financial resources allocated for this purpose and the number of existing beneficiaries, due to the fact that, when the procedure is initiated, because of fluctuations in the institutionalized beneficiaries within the social services of DGASPC Botoșani and the diversity of their daily menus, the quantity of products needed for concluding a contract cannot be established precisely in relation to the food requirements for a budget year; the beneficiaries must receive food every day, with diversified menus, pursuant to the regulations in force, but without there being certain information regarding the total quantity to be purchased. The framework agreement will be concluded with a maximum of 3 (three) economic operators ranked according to the “best price-quality ratio” criterion/lot, where there are three economic operators declared admissible (meeting the conditions requested according to the procurement documentation). Where there are not at least three economic operators, the Framework Agreement will be concluded with all qualified economic operators. The award criterion for the framework agreement/subsequent supply contract is the “best price-quality ratio”/lot. The contracting authority will sign the framework agreement only with the economic operators ranked I, II and III/lot. The subsequent contracts for the period 01.08.2026 - 31.07.2028 will be concluded AT AN INTERVAL OF 8 (eight) months, with the reopening of competition among the EOs that are signatories to the framework agreement, with the subsequent contract to be awarded to the economic operator ranked first by applying the “best price-quality ratio” award criterion/lot. In the cases provided for in Art. 118 para. (1) point b), the contracting authority reopens competition based on the same terms and conditions applied for awarding the framework agreement, detailed where necessary and supplemented, where applicable, with other terms and conditions provided for in the procurement documentation drawn up as part of the procedure for awarding the framework agreement, and in compliance with the following procedural rules: a) for each subsequent contract to be awarded, the contracting authority consults in SEAP the economic operators that are signatories to the respective framework agreement and are capable of performing the contract; b) the beneficiary contracting authority establishes a sufficient period for submitting tenders in SEAP for awarding the contract, taking into account specific elements such as the complexity of the subject matter of the contract and the time required to submit the tenders in SEAP; c) the tenders are submitted in SEAP and will not be opened until the expiry of the period established by the contracting authority. d) During the retendering process, economic operators have the right to modify the element that is the subject of the reopening of competition (PRICE). THE QUANTITATIVE AND VALUE ESTIMATES FOR THE 3 SUBSEQUENT CONTRACTS ARE PROVIDED IN POINTS 3.3.1; 3.3.2; 3.3.3 OF THE SPECIFICATIONS. 3 (three) subsequent contracts will be concluded at an interval of 8 (EIGHT) months, as follows: • Subsequent contract 1 for the period 01.08.2026 - 31.03.2027 • Subsequent contract 2 for the period 01.04.2027 - 30.11.2027 • Subsequent contract 3 for the period 01.12.2027 - 31.07.2028, with competition reopened in SEAP for the conclusion of each subsequent contract. SUPPLY OF Turkey meat, product technical specifications IN ACCORDANCE WITH THE PROVISIONS OF THE SPECIFICATIONS. THE AWARD WILL BE MADE SEPARATELY FOR EACH LOT FOR THE MAXIMUM QUANTITY OF THE FRAMEWORK AGREEMENT, PURSUANT TO POINT 3.3. OF THE SPECIFICATIONS - LOT 2 - boneless turkey breast = 4263 KG; boneless upper turkey thigh = 5049 kg. THE AWARD WILL BE MADE SEPARATELY FOR EACH LOT FOR THE MAXIMUM QUANTITY OF THE FRAMEWORK AGREEMENT, PURSUANT TO POINT 3.3. OF THE SPECIFICATIONS, LOT 2, AS FOLLOWS: Chicken drumsticks - 12381 kg; Boneless chicken breast = 10959 KG; Boneless upper chicken thigh = 19635 KG. PARTIAL TENDERS WITHIN THE LOT ARE NOT ACCEPTED. The products will be vacuum-packed, except for the mici, which will be packaged in trays. THE AWARD WILL BE MADE SEPARATELY FOR EACH LOT FOR THE MAXIMUM QUANTITY OF THE FRAMEWORK AGREEMENT, PURSUANT TO POINT 3.3. OF THE SPECIFICATIONS - LOT 8 canned poultry meat, 300 gr = 10133 pcs; canned beef = 1200; pork pâté = 15048 pcs.
