The subject matter of the contract consists of the procurement of cleaning services at the representative offices of R.A.R.-R.A. LOT 1 TRANSYLVANIA AND LOT 2 MOLDOVA, a procurement financed from its own funds, in accordance with the requirements of the tender specifications. Pursuant to the provisions of Article 160(1) of Law No. 98/2016 (hereinafter referred to as “Law 98”) and Article 103(1) of the Methodological Rules for Law No. 98/2016, approved by Government Decision No. 395/2016 (hereinafter referred to as the “Rules”), any interested economic operator has the right to request clarifications or additional information relating to the procurement documentation, subject to a deadline of 18 days before the deadline for submitting tenders. In accordance with the provisions of Article 160(2) and Article 161(1) of “Law 98”, as well as Article 27(2)-(4) and Article 103(2) of the “Rules”, the contracting authority will provide a consolidated, clear and complete response to all requests for clarifications/additional information on the 11th day before the deadline established for submitting tenders. The contracting authority will not respond to a request for clarifications/additional information received within the 17-day period before the deadline established for submitting tenders, as the request will be considered to have been submitted late. The framework agreement/public procurement contract may be amended during its validity period under the conditions provided for in Article 221 of Law No. 98/2016 and the provisions of ANAP Instruction No. 1/2021. The tender specifications establish the general framework for the requirements relating to the performance of cleaning services at representative offices of the Autonomous Administration - Romanian Automotive Register, under Lot 1 – Transylvania. The requirements in the tender specifications are minimum and mandatory. In this regard, any offer of services that deviates from the provisions of the tender specifications, presents services with characteristics inferior to those provided for therein, or does not meet the requirements imposed therein will be rejected as non-compliant. The procurement will be completed by concluding a framework agreement with a single economic operator for a period of 48 months. Lot 1 – Transylvania (Alba, Arad, Bihor, Bistriţa Năsăud, Braşov, Cluj, Covasna, Harghita, Hunedoara, Maramureş, Mureş, Satu Mare, Sălaj, Sibiu, Timiş). Given that the procurement documentation contains a minimum set of specific information concerning estimates of the minimum and maximum quantities that may be requested throughout the entire duration of the framework agreement, as well as estimates of the minimum and maximum quantities that may be the subject of a single subsequent contract among those to be awarded during the term of the framework agreement, we emphasize that these minimum and maximum quantities initially established by the contracting authority in the procurement documentation and subsequently in the framework agreement are estimates of quantities that may be requested throughout the entire duration of the framework agreement and not the exact quantities that will be procured; the latter may be lower than, equal to, or higher than those estimated, depending on the contracting authority’s actual needs. Value of the largest subsequent contract: 2.748.960,00 lei excluding VAT. The Promising-Purchaser reserves the right/option to increase the quantity estimated in the procurement documentation by up to a maximum of 10% of the maximum quantity for the framework agreement/subsequent contract, for each category of services separately. The price of the services that will be procured additionally under the review clause will be the price stated in the financial proposal underlying the framework agreement (adjusted, where applicable, according to the adjustment formula), and the period during which this option may be exercised by the Promising-Purchaser is throughout the validity period of the framework agreement/subsequent contract. In view of the review clause above, the estimated value of the procedure, as stated in Section II.1.5 of the data sheet, will be expressed as a range, with the minimum value of the range representing the estimated value of this procedure according to which the tenders will be evaluated, while the maximum value represents the estimated value that also includes the value of possible increases under the review clause). Thus, the maximum value of the range stated in Section II.2.6 of the data sheet, namely the value resulting from possible increases to the maximum of the framework agreement, is 12.095.424,00 lei excluding VAT for Lot 1 Transylvania. The amendment of the framework agreement/subsequent contract under this review clause falls within the non-substantial amendment governed by Article 221(1)(a) of Law No. 98/2016, having all the elements provided for in Article 2(1)-(2) of ANAP Instruction No. 1/2021.
