Opportunity description

The subject matter of this procurement consists of the purchase of cleaning services at the contracting authority’s locations, through the conclusion of a framework agreement for the period 01.11.2025 – 31.10.2027. The cleaning services will be provided through: - the provision by the economic operator of the human resources who will carry out the cleaning activities for the premises; - the provision of materials/solutions, as well as certain sanitary and hygiene consumables necessary for the provision of the cleaning services; - the provision of material resources consisting of equipment/machinery necessary for the provision of the cleaning services; - the provision of professional cleaning services for exterior glazed surfaces located at great height; - the provision of professional cleaning services for curtains and drapes; - the provision of professional cleaning services for flags; - the provision of professional cleaning services for carpeted surfaces; - the provision of professional cleaning services for power-floated concrete surfaces. The cleaning services will be provided through: - the provision by the economic operator of the human resources who will carry out the cleaning activities for the premises; - the provision of materials/solutions, as well as certain sanitary and hygiene consumables necessary for the provision of the cleaning services; - the provision of material resources consisting of equipment/machinery necessary for the provision of the cleaning services; - the provision of professional cleaning services for exterior glazed surfaces located at great height; - the provision of professional cleaning services for curtains and drapes; - the provision of professional cleaning services for flags; - the provision of professional cleaning services for carpeted surfaces; - the provision of professional cleaning services for power-floated concrete surfaces. The framework agreement will be concluded with a single economic operator for a period of 24 months, namely for the period 01.11.2025-31.10.2027. The framework agreement and subsequent contracts will be concluded with the tenderer whose tender has been declared admissible and ranked first following application of the award criterion. Subsequent contracts will be awarded without reopening the competition. Each subsequent contract will be concluded subject to the availability of budgetary funds. Invoicing and the transmission of tax invoices will be carried out exclusively through the national RO e-Factura electronic invoicing system. Review clauses The unit prices will remain firm throughout the validity period of the framework agreement, except for the “salary costs” component, which will be adjusted if, during the performance of the framework agreement, legislative amendments concerning an increase in the national minimum wage occur. Salary costs will be adjusted by the difference between the amount of the increased national minimum wage and the amount of the national minimum wage taken into account when awarding the framework agreement. The framework agreement and the subsequent contracts may be amended only pursuant to Art. 221 of Law 98/2016. The following situations constitute review clauses provided for in the procurement documentation and will apply directly pursuant to Art. 221 para. (1) point a) of Law 98/2016 by amending, as applicable, the framework agreement/subsequent contracts: 1. The framework agreement/subsequent contract may be amended if, during its performance, it becomes necessary to introduce a new location where cleaning services will need to be provided as a result of the contracting authority acquiring that location by any means. In this situation, the services will be provided for a larger number of locations, requiring additional cleaning staff and equipment, the provision of additional quantities of materials/solutions necessary for cleaning and sanitary and hygiene consumables, and the contracted professional services. The quantity of additional services will be determined by reference to one of the locations where cleaning services are already being provided that is comparable in terms of surface area, taxpayer traffic, number of employees, etc., a situation that will also implicitly lead to an increase in the value of the framework agreement/subsequent contract by the value corresponding to the additional quantity of services. 2. If either party identifies, at any time during the performance period of the framework agreement/subsequent contracts, a clerical error that has found its way into their contents. In this situation, the error in the content of the framework agreement/subsequent contracts will be rectified. 3. The framework agreement/subsequent contracts may be amended as a result of legislative amendments concerning an increase in the national minimum wage (guaranteed for payment) taken into account in the substantiation and calculation for the cleaning services. In this situation, the price of the framework agreement/subsequent contract will be adjusted strictly in respect of the “salary costs” component and only by the difference between the amount of the national minimum wage (guaranteed for payment) increased as a result of the legislative amendments and the national minimum wage (guaranteed for payment) taken into account when awarding the framework agreement. 4. The framework agreement/subsequent contracts may be amended if, during their performance, it becomes necessary to remove one or more locations where cleaning services were being provided as a result of the closure of the respective location(s). In this situation, the cleaning services under the framework agreement/subsequent contract will be reduced accordingly by the quantity of services that will no longer be provided at that/those location(s), in which case the value of the framework agreement/subsequent contract will also be reduced accordingly by the value corresponding to the reduced quantity of services. 5. The removal of one or more locations from the framework agreement and, at the same time, the introduction of one or more new locations into the framework agreement, without leading to changes in the quantities of services and, implicitly, without changes to the value of the framework agreement/subsequent contract. In this situation, only the change of location will be reflected. All categories of amendments provided for in points 1-5 will be made through the conclusion of an addendum and only provided that they do not affect the overall nature of the framework agreement/subsequent contracts.
