The object of the procurement consists of signing a Framework Agreement, with a duration of 36 months from the date of entry into force of the Framework Agreement, which shall establish the terms, conditions, as well as the legal, financial, technical, and administrative framework for awarding subsequent Contracts, with a view to ensuring that the Tenderers provide, under conditions of safety, promptness, and financial efficiency, works supervision services consisting of site management, occupational health and safety (SSM), and Supervision for investments carried out within Sector 4 of the Municipality of Bucharest. The subsequent contracts to be concluded during the implementation of the framework agreement shall have as their object: 1. Site management and occupational health and safety (SSM) services for investments carried out by the contracting authority up to the threshold for which the provisions of Government Decision H.G 1/2018 apply, requiring works of low complexity, characterized by a limited number of fields of authorization for site managers and a small number of specialized/authorized persons, mandatory under the legal provisions for carrying out the works; 2. Site management, occupational health and safety (SSM), and supervision services (point III of the specifications), for investments carried out by the contracting authority up to the threshold for which the provisions of Government Decision H.G 1/2018 apply, requiring works of high complexity, characterized by an extensive number of fields of authorization for site managers, a variety of specialized/authorized persons involved, mandatory under the legal provisions for carrying out the works, and whose efficient and lawful implementation requires their supervision/coordination; 3. Supervision/coordination (point IV of the specifications) for certain categories of procurement contracts relating to investment objectives financed from public funds, approved by Government Decision HG No. 1/10.01.2018, as subsequently amended, also including the services under points I and II of the specifications, in accordance with the legal requirements governing them. The duration of subsequent contracts concluded during the validity period of the framework agreement may exceed the duration of the framework agreement and shall extend until the complete completion of the activities constituting their object, taking into account any forms of extension, in correlation with the investment for whose supervision the contracting authority contracts the services under this framework agreement. The estimated minimum and maximum quantities for the duration of the framework agreement, as well as for one subsequent contract, are described in the Specifications. Note: In this documentation, the concept of investment must be understood in a broad sense and refers to works contracts carried out within the contracting authority, for which the legal provisions impose the obligation to procure services in the category of those constituting the object of the framework agreement. The concept of investment in this documentation does not refer to and must not be regarded as a category of contracts whose financing is to be provided strictly from the investments budget chapter, but as the result of works contracts, regardless of the funding source and the budget chapter from which financing is provided, but which, according to legal requirements, require the provision of services among those constituting the object of the framework agreement. Considering that the award documentation contains a minimum set of specific information regarding estimates of the minimum and maximum quantities that might be requested throughout the entire framework agreement, as well as estimates of the minimum and maximum quantities that might be the object of a single subsequent contract among those to be awarded during the framework agreement, we emphasize that these minimum and maximum quantities initially established by the contracting authority in the award documentation and subsequently in the framework agreement represent estimates of quantities that might be requested throughout the entire framework agreement and not the exact quantities that will be procured, the latter being potentially lower than, equal to, or higher than those estimated, depending on the actual needs of the contracting authority. Number of days before the deadline for submission of tenders by which clarifications may be requested: 18 days. Clarifications requested after this deadline will no longer be taken into consideration. The contracting authority will respond clearly and completely to all requests for clarification/additional information on the 11th day before the deadline established for the submission of tenders. 1. Supervision/coordination (point IV of the specifications) for certain categories of procurement contracts relating to investment objectives financed from public funds, approved by Government Decision HG No. 1/10.01.2018, as subsequently amended, also including the services under points I and II of the specifications, in accordance with the legal requirements governing them. The framework agreement/public procurement contract may be amended during its validity period under the conditions provided for in Article 221 of Law No. 98/2016 and the provisions of the ANAP Instructions in force at the time the amendment is initiated.
