The contracting authority is purchasing the technical assistance service - site supervision provided by specialized technical personnel, authorized in accordance with the provisions of Order of the Minister of Regional Development and Tourism No. 1496/2011, for the proper execution of the works related to the investment objective “Construction of a Cross-Border Disaster Response Center – Constanța County, Palas Fire Brigade,” financed through the Strategic Program “Streamlining cross-border cooperration: Joint approch in disaster resilience - STREAM” under the INTERREG VI-A Romania-Bulgaria cross-border cooperation program, relating to the 2021-2027 period, in the locality of Constanța. The construction of a new administrative building is envisaged, which will provide sufficient office space for all personnel within I.S.U. Dobrogea of Constanța County to carry out their activities under optimal working conditions, and the equipping of the rooms with state-of-the-art equipment and installations. In accordance with the provisions of Chapter III, Section 1 - Obligations and liabilities of investors, Article 22(d) of Law No. 10/1995, investors have the obligation to “ensure verification of the proper execution of construction works through specialized site supervisors or specialized consulting economic operators, throughout the works.” Thus, for the successful implementation of the aforementioned investment objective within the contracted period, in conjunction with the need to ensure the proper verification of all works related thereto, the contracting authority is purchasing the technical assistance service - site supervision provided by specialized technical personnel, authorized in accordance with the provisions of Order of the Minister of Regional Development and Tourism No. 1496/2011. Site supervision may be provided either by an authorized natural person or by a commercial company whose activity includes construction consulting services - site supervision, hereinafter referred to as the Service Provider. Through the site supervision services, the execution of all works related to the investment objective will be supervised, verified, controlled, and monitored in terms of the parameters of quality, time, cost, and safety. In this document, for ease of expression, the terms Tenderer and Service Provider will also be used and will have the same meaning. The site supervisor will carry out their activity as the Beneficiary’s representative in relations with the designer, builder, suppliers, and service providers during the performance of the works contract. The site supervisor’s activity will be governed by the following principles: - Acting exclusively in the beneficiary’s interest, both in relation to the contractor and in relation to the designer, suppliers, service providers, inspection bodies, etc.; - Applying professionalism in their own activity; - Total loyalty to the investment beneficiary; - Compliance with all legal provisions and technical regulations applicable in the areas covered by the investment objective. Number of days before the deadline for submitting tenders/applications by which clarifications may be requested: 25 days. The consolidated response to requests for clarification will be sent to economic operators at least 16 days before the deadline for submitting tenders. Any request for clarification concerning the procurement documentation shall be submitted only through SEAP (https://e-licitație.ro), by accessing the dedicated “Questions” section in the details of the ongoing procurement procedure. In order to comply with the principle of equal treatment, interested economic operators shall comply with the provisions of ANAP Notification No. 247 concerning the method for submitting requests for clarification and additional information regarding procurement documentation / responses formulated when conducting public procurement contract award procedures by electronic means (online), meaning that documents attached to the “Questions” section MUST NOT CONTAIN THEIR IDENTIFICATION DATA, since these will become public when the response is transmitted by the contracting authority!
