Romania – Construction work for highways, roads – Design and Execution of the A1 Road Junction (km 326+155) – DJ 704 (Cugir)

Opportunity description

The subject of the contract is the design and execution of the Road Junction located on the A1 Motorway (km 326+155) – DJ 704 (Cugir), in accordance with the provisions of the works contract. In accordance with the provisions of Article 160(1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information concerning the procurement documentation is 25 days before the deadline for submission of tenders. In accordance with the provisions of Article 160(2) of Law No. 98/2016, as subsequently amended and supplemented, the Contracting Authority establishes a single deadline by which it will respond to all requests for clarification/additional information, as follows: 12 days before the deadline for submission of tenders. The deadline for responding to requests for clarification was established so that economic operators have an adequate period to analyze the procurement documentation and subsequently prepare their tenders in light of the responses provided by the Contracting Authority. The subject of the contract is the design and execution of the Road Junction located on the A1 Motorway (km 326+155) – DJ 704 (Cugir), in accordance with the provisions of the works contract. In accordance with the contractual provisions, namely Government Decision No. 1/2018, any modifications that may occur during the contract performance period concern the following, without being limited thereto: 1. Modifications to the contracting parties, including replacement of the contractor with a new contractor under the conditions provided for in Article 221(1)(d), point (ii); 2. A change in the name and/or legal form of the company, where such changes do not entail the creation of a new legal entity; 3. Modifications resulting from adapting the Detailed Technical Design to actual site conditions, including changes to specific technical solutions; 4. Modifications resulting from changes/adaptations to the levels, positions and/or dimensions of certain works due to site conditions; 5. Modifications arising from requirements of the environmental authorities; 6. Modifications resulting from the need to move/relocate certain objects located on/in the ground/subsoil; 7. Modifications arising from the inclusion of new subcontractors/suppliers/subcontractors of subcontractors/any other economic operators and/or arising from the replacement of the original subcontractors/suppliers/subcontractors of subcontractors/any other economic operators, which will be carried out in accordance with the corresponding clause of the General Conditions of Contract; 8. Modifications arising from changes to key personnel/other personnel, which will be carried out in accordance with the corresponding clause of the General Conditions of Contract; 9. Modifications to the expropriation route/corridor that result in the need to carry out additional works and/or to abandon certain works included in the Contract; 10. Modifications arising from agreements, conventions or arrangements between the state/local authorities and other states; 11. Legislative changes or changes to technical rules/STAS standards/regulations/standards during the performance of the contract, which will be implemented in accordance with the corresponding clause of the General Conditions of Contract, in compliance with the provisions of Article 221 of Law No. 98/2016, as subsequently amended and supplemented; 12. Extension of the Execution Period based on the contractual mechanism provided for in Clause 35 [Extension of the Execution Period] of the General Conditions, without prejudice to the Beneficiary's right to impose on the Contractor the penalties and/or sanctions provided for in the contract; 13. Modifications resulting from the implementation of requests from various institutions/authorities/entities having responsibilities related to the investment objective (for example: Ministries, JASPERS, central and/or local Authorities/Institutions, Certified Verifiers, control bodies, etc.). 14. Modifications resulting from archaeological clearance. 15. Modifications arising from changes to the land and the above-ground and underground hydrographic network that were unknown on the date the Detailed Technical Design was prepared; The modifications will be made after the contract is signed, in accordance with the contractual provisions, only provided that they do not constitute substantial modifications within the meaning of Article 221(7) of Law No. 98/2016.
