The objective concerning the design and execution of works for “CONSTRUCTION OF DJ 172 ROAD UNDERPASS AT THE INTERSECTION WITH THE RAILWAY LINE AND DN17 IN BECLEAN, BISTRIȚA NĂSĂUD COUNTY” was selected for financing under the North-West Regional Programme 2021-2027, PRNV/2023/522.A/1 - Solutions for increasing traffic safety - investments in road infrastructure safety to meet these needs. The design services and the execution of the works proposed for the investment objective covered by the contract are described in detail in - the specifications; - the feasibility study relating to the investment objective “CONSTRUCTION OF DJ 172 ROAD UNDERPASS AT THE INTERSECTION WITH THE RAILWAY LINE AND DN17 IN BECLEAN, BISTRIȚA NĂSĂUD COUNTY”. Any interested economic operator has the right to request clarifications/additional information regarding the tender documentation up to the 22nd day before the deadline for submission of tenders. The contracting authority will respond clearly and completely to all requests for clarifications/additional information regarding the tender documentation on the 12th day before the deadline for submission of tenders. The contracting authority will not respond to requests for clarification submitted after the established deadline. Any request for clarification must be submitted in SEAP, signed with an extended electronic signature based on a qualified certificate issued by an accredited certification service provider. The works proposed under this investment objective are described in the Feasibility Study – scenario 1, attached to and forming an integral part of the tender documentation. The feasibility study proposes the construction of an underpass beneath railway lines CF 416 and CF 418, necessary to improve traffic flow on DJ 172. The construction of a new underpass at km 25+805, oblique to the railway route, with an obliquity of 24 °, consisting of reinforced concrete elements, with a length of 17.00 m (of which 11.00 m covered) + ramps with a length of 122.74, is proposed. Thus, the following types of works are proposed for the implementation of the investment objective: - Demolition works for existing structures (road structure, tracks, etc.) - Rainwater collection works - Utility diversion works; - Works for construction of the carriageway - Works for construction of the underpass - Works for the installation of public lighting, electricity supply, traffic monitoring systems - Works for the development of safety areas; - Traffic safety works (markings, road signs, guardrails and other elements), - Works to restore the natural environment - Works concerning site organization in accordance with the requirements imposed by the specifications and the Feasibility Study, documents that form an integral part of the tender documentation. The works fall within importance category C in accordance with Government Decision no. 766/1997. Thus, the minimum duration of the warranty period will be 3 years pursuant to Law no. 10/1995, republished, with its subsequent amendments and additions. The objective falls within technical category II, having 1 traffic lanes, one in each direction. The duration of the contract is 18 months. The contracting authority has planned the completion of the design services within 6 months (4 months for preparation of the PTE + 2 months for obtaining endorsements, agreements) from the issuance of the order to commence the provision of services, a period that also includes obtaining the authorizations, endorsements, agreements, etc. necessary for the execution of the works, and completion of the execution of the works within 12 months from the issuance of the order to commence execution of the works, a period that also includes the period of 1 months for completion of acceptance upon completion of the works. Miscellaneous and unforeseen expenditure is included in the General Cost Estimate and the bills of quantities prepared at the SF stage and has an indicative role, being used by the contracting authority to determine the estimated value of the public procurement contract; economic operators are not required to use it when preparing the financial proposal in the tender. The implementation reserves shall be used with the approval of the Contracting Authority, in accordance with the methodology described in the contractual agreement and in compliance with the applicable legislative provisions, provided that the following conditions are cumulatively met: a. the contract relates to an investment objective in the field of public transport infrastructure; b. the investment objective is financed from European funds. Conditions of application (cumulative): a. use of the reserve is strictly necessary for implementation of the Contract; b. use of the reserve is caused by circumstances beyond the control of the Contracting Authority or the Contractor, or use of the reserve is caused by circumstances that could not be accurately foreseen on the date the procedure for awarding the public procurement contract was organized. The values relating to the budget margin and the establishment of the implementation reserve, from which any price adjustments will be made or which will cover the situations provided for in Article 13 of ANAP Instruction no. 1/2021, represent expenditure to which general clause 49.3 of the model contract will apply.
