Design services, technical verification, technical assistance from the designer during the execution of the works, and execution of the construction and installation works related to the project “Energy Efficiency Improvement of Mircea Eliade Secondary School”. The contract is not divided into lots. The number of days before the deadline for submission of tenders by which clarifications may be requested, as established by the contracting authority, is 18 days. The contracting authority will respond fully to all requests for clarification on the 11th day before the deadline for submission of tenders. Insofar as requests for clarification or additional information have been submitted within the deadline specified in the contract notice, the contracting authority will respond to all requests for clarification within the period established in the procurement documentation. This procedure is initiated with a suspensive clause. The award/procurement procedure is initiated subject to this suspensive clause, meaning that the conclusion of the public procurement contract is conditional upon the conclusion of the financing contract, and the contract will be signed in compliance with the provisions concerning the commitment of expenditure from budgets that fall under public finance legislation. In view of the provisions of Law 98/2016 and Government Decision No. 395/2016, as subsequently amended and supplemented, the Contracting Authority specifies that it will conclude the contract with the tenderer declared the winner only insofar as the funds required for the procurement are secured through the signing of the financing contract under PRSM 2021-2027 with the South-Muntenia Regional Development Agency (ADR). If, regardless of the reasons, the financing contract is not signed, the Contracting Authority, after receiving notification from the South-Muntenia Regional Development Agency (ADR) regarding the refusal of financing, reserves the right to cancel the award procedure, provided that there is no other source of financing, in accordance with the provisions of Article 212(1)(c), second sentence, of Law No. 98/2016, as subsequently amended and supplemented, since concluding the public procurement contract would be impossible. Tenderers participating in this procedure understand that the Contracting Authority and/or the South-Muntenia Regional Development Agency (ADR), which provides the financing, cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority and/or the South-Muntenia Regional Development Agency (ADR) were notified of the existence of such damage. Tenderers participating in this procedure accept the use of the above special conditions/the suspensive clause, assuming full liability in relation to any damage they may suffer in the situation described. In applying the aforementioned suspensive clause, if the financing decision is not issued by the date on which the initial tender validity period expires, the Contracting Authority has the right to request that the contractor extend the tender validity period and, correspondingly, the participation guarantee. Tenderers are required to respond to the request within the period indicated by the Contracting Authority; a negative response or failure to respond within the requested period will make it impossible to sign the contract, and the respective tender will be considered withdrawn, without this resulting in enforcement of the participation guarantee. Design services, technical verification, technical assistance from the designer, and execution of the works for the investment objective “Energy Efficiency Improvement of Mircea Eliade Secondary School”. The design, technical verification, technical assistance from the designer, and execution of the construction and installation works for the investment objective “Energy Efficiency Improvement of Mircea Eliade Secondary School” will be carried out in accordance with the requirements of the specifications, the documentation for approval of intervention works approved by Local Council Decision No. 39/25.01.2024, the tender, namely the technical proposal and the financial proposal, as well as the contractual and legal provisions applicable in the field of design and execution of construction works. The duration of the design services and execution of the works is 12 months. Technical assistance from the designer will be provided throughout the execution of the works, until acceptance upon completion of the objective without objections. The award procedure is initiated subject to a suspensive clause, with the conclusion of the contract conditional upon securing the source of financing and signing the financing contract under the “South-Muntenia Energy Efficiency for Public Buildings Investment Programme”, from non-reimbursable funds, the state budget, and the local budget, under the conditions set out in the specifications.
