Brief description of the contract or procurement(s) During the week, a preschool child/pupil is provided free of charge with 2 portions of fruit (apples), 5 portions of milk and 5 portions of bakery products, within the amounts allocated for these purposes. A preschool child/pupil attending classes may consume more than one portion of a product on the same day as a result of the redistribution of products not consumed for objective reasons, but European Union financial aid will be requested within the limit of 2 portions of fruit (apples) and 5 portions of milk provided free of charge over the course of one week. Upon the reasoned request of parents, preschool children or pupils who suffer from intolerance to gluten and/or lactose and/or any other ingredient or compound and/or any product distributed in accordance with the provisions of Art. 3 para. (3) of Government Decision No. 652/2023 or tasted in accordance with the provisions of Art. 5 para. (3) of the same decision will receive products appropriate to their circumstances, within the daily value provided for in Art. 3 para. (1) of Government Decision No. 652/2023. The provisions of Art. 4 para. (3), Art. 5 paras. (2) and (4), Art. 9 paras. (3), (7) and (8) of Government Decision No. 652/2023 refer to scenarios for organizing and conducting classes in the educational institution under epidemiologically safe conditions to prevent illnesses, as provided for by the legislation in force in national epidemiological situations and approved during states of alert and emergency, as well as in cases of labor disputes. In accordance with Art. 3 para. (l) of Government Decision No. 775/2025, the daily value limit for the products distributed is: - 0.80 lei for the portion of fruit and vegetables; - 1.18 lei for the portion of drinking milk and dairy products without added milk powder; - 0.76 lei for the portion of bakery products. The daily value limit includes the full purchase price of the products, including value-added tax and their transportation, distribution and storage costs, as applicable. Number of days before the deadline for submission of tenders/applications by which clarifications may be requested: 18 The contracting authority will respond clearly and completely to all requests for clarification / additional information on the 11th day before the deadline for submission of tenders. The number of pupils in public and private primary and lower-secondary education, as well as the number of preschool children in public and private kindergartens with a standard 4-hour schedule, in the Municipality of Reșița for the 2026-2027 school year, is 4,466 beneficiaries, according to the responses submitted by the educational institutions to address No. 59580/25.06.2025. The structure of the 2026-2027 school year established by Order of the Minister of Education No. 3.194/09.02.2026 is 36 weeks – 171 school days. The daily value limit/preschool child/pupil will be calculated in accordance with Art. 3 of Government Decision No. 775/2025. To estimate the minimum quantities required for the 2027-2028 and 2028-2029 school years, we took into account the structure of the 2026-2027 school year, as well as the same number of pupils in public and private primary and lower-secondary education and the number of preschool children in public and private kindergartens with a standard 4-hour schedule, according to the responses submitted by the educational institutions to address No. 59580/25.06.2025. The minimum total estimated value required to perform the framework agreements to be awarded was established taking into account the following elements: - The number of school days, according to the structure of the 2026-2027 school year, is 171; for the 2027-2028 and 2028-2029 school years, we will maintain (estimate) the same number of days; - The quantity is estimated because only pupils attending classes are entitled to receive products daily during the period of classes, according to the structure of the school year; - The minimum estimated quantities and values for each individual lot are determined by the number of beneficiaries aggregated following the responses submitted by the educational institutions to address No. 59580/25.06.2025. - The daily value limit includes the full purchase price of the products, including value-added tax and their transportation, distribution and storage costs, as applicable; The maximum quantity was estimated taking into account the fact that the framework agreement is concluded for a period of 3 school years, as well as the experience of previous years, in which the number of pupils/preschool children initially reported by the educational institutions and the Caraș-Severin County School Inspectorate increased. Thus, the estimated 10% increase for each school year (2026-2027, 2027-2028 and 2028-2029) in the number of pupils/preschool children is justified, as is the possibility of extending the 2027-2028 and 2028-2029 school years by 2 weeks (10 days/year) compared with the structure of the 2026-2027 school year.
