Signing a sectoral framework supply agreement for a period of 12 months for the procurement of “Products necessary for the integration of metering points at prosumers into Smart Metering Systems” in accordance with the specifications in the CS and FT. According to the reasons stated in the documents prepared by the specialized service, documents attached hereto, the purpose is to comply with the requirements of ANRE Order No. 19/2022, the Procedure regarding the connection of prosumers, through the procurement of single-phase meters and three-phase direct-connected meters. The Contracting Entity must comply with the legislation in force regarding the connection to electricity networks of public interest of consumption and production sites belonging to prosumers. The number of days before the deadline for submission of the tender by which potential tenderers may request clarifications regarding the procurement documentation is 20. The Contracting Entity will respond to all requests for clarification or additional information on the 11th day before the deadline established for the submission of tenders. The Contracting Entity will respond only to requests for clarification submitted by economic operators by the deadline established above. II.1.4) Brief description - conclusion of a framework agreement for products for the procurement of “Products necessary for the integration of metering points at prosumers into Smart Metering Systems” - in accordance with the specifications in the CS, in compliance with all parameters included in the attached technical data sheets. Total estimated value – minimum 417,000.00 lei excluding VAT and maximum 20,850,000.00 lei excluding VAT. Estimated minimum quantity under the AC: 500 units (single-phase meter) and 500 units (three-phase meter); estimated maximum quantity under the AC: 25,000 (single-phase meter) and 25,000 (three-phase meter). Value of the largest subsequent contract: 10,500,000.00 lei. Estimated maximum quantity of the largest subsequent contract under the CS: 12,500 units (single-phase meter) and 12,500 units (three-phase meter); estimated timetable for awarding subsequent contracts: they will be awarded according to needs as they arise. The first subsequent contract will be awarded after conclusion of the framework agreement. Estimated minimum and maximum number of CS to be concluded: minimum 2 and maximum 4. Frequency of subsequent contracts: minimum 2 and maximum 4 throughout the duration of the AC. DELIVERY DEADLINE for the CS: in installments, pursuant to Art. 3.3.1 of the Specifications. The framework agreement will be signed with a minimum of 1 and a maximum of 3 economic operators. Pursuant to AC template 11.5. (1) For the signing of subsequent contracts, the Promising Contracting Entity will always approach the Promising Supplier with the lowest price that is a party to the framework agreement. (2) If Promising Supplier 1 does not sign the subsequent contract within the period provided for in Art. 11.4 (1), the Promising Contracting Entity will approach Promising Supplier 2. If Promising Supplier 2 does not sign the subsequent contract within the period provided for in Art. 11.4 (1), the Promising Contracting Entity will approach Promising Supplier 3. (3) If Promising Supplier 3 also does not sign the subsequent contract within the period provided for in Art. 11.4 (1), the framework agreement will be terminated pursuant to Art. 16.8.(1), point d). Art. 11.4. (1) The Promising Supplier is required to sign the subsequent contract within a maximum of 5 working days from the date of receipt. Art. 16.8.(1) Termination of the Framework Agreement occurs without prior notice from the Promising Contracting Entity as a result of: if all Promising Suppliers refuse to sign the same subsequent contract.
