Opportunity description

The framework agreement/Contract will ensure the procurement of organization and logistical support services for the training of approximately 1965 MIPE employees, consisting of rental of course rooms, accommodation of participants, provision of meals and coffee breaks, transport of participants, promotional materials. The framework agreement will have a duration of 20 calendar months, and the implementation period may not exceed the date of 30.11.2027. The Contracting Authority has chosen as the award method the conclusion of a framework agreement with no more than three economic operators, namely with the economic operators whose admissible tenders were ranked in the first three places. Method of awarding subsequent contracts: without reopening the competition, the subsequent contract will be awarded to the Promising provider ranked first, depending on the needs and budgetary funds that may be made available for this purpose. If the Promising provider ranked first does not have the capacity to respond to the Promising purchaser's request or refuses to sign the subsequent contract, the subsequent contract will be concluded with the Promising provider ranked second. If the Promising providers ranked in the first two places do not have the capacity to respond to the Promising purchaser's request or refuse to sign the subsequent contract, the subsequent contract will be concluded with the Promising provider ranked third. If none of the Promising providers is able to provide the services that are the subject of the subsequent contract that the Promising purchaser intends to conclude or refuses to sign it, as well as if delays arising through the fault of the Promising provider in the project implementation schedule lead to failure to achieve the established objectives or result in the need to organize a new award procedure for a new framework agreement, generating additional costs, each Promising provider owes the Promising purchaser damages amounting to 10% of the value of the subsequent contract in question. Total estimated value of the procurement: the maximum estimated budget of the framework agreement is 5.749.736,75 lei excluding V.A.T. The minimum estimated budget of the framework agreement is 2.799.267,55 lei excluding VAT. The estimated budget of the largest subsequent contract is 2.799.267,55 lei excluding VAT. The estimated budget of the smallest subsequent contract is 998.484,00 lei excluding VAT. The contracting authority will conclude the framework agreement with the first 3 economic operators whose admissible tender was ranked in the first 3 places following the application of the award criterion—the best quality/price ratio. If two or more tenders have the same total score, they will be distinguished and the winning tender will be determined according to the score obtained for the “tender price” factor. If the tie remains, the distinction will be made taking into account the score obtained for the “technical component—experience of the economic operator” evaluation factor. If the tie remains, the contracting authority has the right to request new financial proposals, and the tender with the lowest financial proposal will be designated the winner. Economic operators are required to maintain the validity of their tender for 6 months from the deadline for submission of tenders. Contract duration: 20 months from the time the contract is signed by the last party, but no later than 30.11.2027. Participation guarantee: Not applicable. Performance guarantee: the establishment of a performance guarantee amounting to 10% of the contract value excluding VAT is required. In accordance with the provisions of Article 154 para. (3) and para. (4) of Law No. 98/2016, as subsequently amended and supplemented, taking into account the specific nature of the services that are the subject of this procurement, for the purpose of assuring the contracting authority that the qualitative requirements of the services will be fulfilled and within the agreed period of the framework agreement, it is considered necessary for the economic operator signing the subsequent contract to establish the contract performance guarantee. Pursuant to Article 154 para. (3) of Law No. 98/2016, as subsequently amended and supplemented, the value of the performance guarantee is established in relation to the complexity of the subsequent contract at an amount corresponding to 10% of the value of the subsequent contract, excluding VAT. The validity period of the performance guarantee will be equal to the duration of the subsequent contract.
