SUSPENSIVE CLAUSE: “The conclusion of the sectoral procurement contract is conditional upon obtaining/approving the financing of the works from state budget funds and/or European funds, the contract being able to be signed only if the provisions concerning the commitment of expenditure from budgets falling under the legislation on public finances are complied with. If, regardless of the reasons, the financing of the works from state budget funds and/or European funds is not obtained/approved, the Contracting Entity will apply the provisions of Article 225(1)(c), second sentence, of Law 99/2016, as subsequently amended and supplemented, and it will be impossible to conclude the sectoral procurement contract. The Contracting Entity estimates that it will obtain the financing necessary to sign the contract within 12 months of the approval of the procedure report”. The service to be procured consists of preparing the feasibility study for: Electrification of 6 traffic sections of Romania’s railway system – Lot 2: Pitești - Slatina – Craiova - SRCF Craiova. When preparing the Feasibility Study, the Contractor shall comply with the applicable regulatory and legislative acts specific to railway infrastructure and construction that are in force, with a view to presenting a ˮmatureˮ project corresponding to the most efficient technical-economic solution, for which the provision of the funding source for implementing the investment objective is to be approved, while ensuring the technical specifications for interoperability within Romania and compliance with the standards imposed for the European Corridors and TEN-T Corridors. The Feasibility Study will identify and present the optimal investment option from a technical, economic and operational perspective for achieving the general and specific objectives, taking into account its compliance with the technical interoperability requirements laid down by EU and national regulations. The provisions of specifications no. 134/5/16.01.2025 shall be taken into account. Any interested economic operator has the right to request clarifications/additional information concerning the procurement documentation up to the 22nd day before the deadline for submitting tenders. The Contracting Entity will respond clearly and completely to all requests for clarifications/additional information concerning the procurement documentation on the 12th day before the deadline for submitting tenders. The Contracting Entity will not respond to requests for clarification submitted after the established deadline. Any request for clarification must be submitted through SEAP and signed with an extended electronic signature.
