Opportunity description

Procurement of a “Chemical fume hood and rotary evaporator under the METROFOOD-RI project, MySMIS code 309287,” in accordance with the specifications in the tender specifications. Number of days before the deadline for the submission of tenders/applications by which clarifications may be requested: 20 days. The contracting authority will respond clearly and completely to all requests for clarification: on the 11th day before the deadline established in the contract notice for the submission of tenders. Any request for clarification must be submitted through SEAP (https://www.e-licitatie.ro). Completion of the award procedure through the conclusion of the public procurement contract is subject to the following condition precedent, which will apply for a maximum period of 3 months from the deadline for the submission of tenders: The conclusion of the public procurement contract is conditional upon the continuation of funding under the Project “Strengthening the integration of the Romanian METROFOOD-RO node into the European METROFOOD-RI research infrastructure” (METROFOOD-RO Evolve), MySMIS code 309287, and the contract may be signed only if the provisions concerning the commitment of expenditure from budgets falling under the legislation on public finances are observed, and in compliance with the provisions of Government Decision No. 395/2016 approving the Methodological Rules for the application of the provisions concerning the award of the public procurement contract/framework agreement under Law No. 98/2016 on public procurement, as subsequently amended and supplemented. If, regardless of the reasons, funding is not continued under the Project “Strengthening the integration of the Romanian METROFOOD-RO node into the European METROFOOD-RI research infrastructure” (METROFOOD-RO Evolve), MySMIS code 309287, the contracting authority will apply the provisions of Article 212(1)(c), second sentence, of Law No. 98/2016, as subsequently amended and supplemented, making it impossible to conclude the public procurement contract. Tenderers in this procedure understand that the Contracting Authority and/or MEC cannot be held liable for any damage in the event that the award procedure is cancelled, regardless of its nature and regardless of whether the Contracting Authority and/or MEC were notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/condition precedent, assuming full liability in relation to any damage they may suffer in the situation described.
