Opportunity description

The objective of the framework agreement is the purchase of the products covered by the specifications, namely furniture products, including school furniture and educational equipment. The subject matter of this procurement is the signing of a Framework Agreement with a validity period of 48 months, establishing the terms, conditions, as well as the legal, financial, technical and administrative framework for the award of subsequent contracts, for the supply of the products described in the specifications. The duration of subsequent contracts concluded during the validity period of the framework agreement may exceed the duration of the framework agreement. The products are described in the Specifications, which contain all the information necessary for preparing the tender. Number of days before the deadline for submission of tenders by which clarifications may be requested: 18 days. Clarifications requested after this deadline will no longer be taken into consideration. The Contracting Authority will respond clearly and completely to all requests for clarification/additional information on the 11th day before the deadline established for the submission of tenders. Estimates of the minimum and maximum quantities that might be requested over the entire duration of the framework agreement and those that might be covered by a single subsequent contract among those to be awarded during the Framework Agreement are set out in the specifications. Modification of the framework agreement/public procurement contract during its validity period may be carried out under the conditions provided for in Article 221 of Law No. 98/2016 and the provisions of ANAP Instruction No. 1/2021. Given that the procurement documentation contains a minimum set of specific information regarding estimates of the minimum and maximum quantities that might be requested over the entire duration of the framework agreement, as well as estimates of the minimum and maximum quantities that might be covered by a single subsequent contract among those to be awarded during the framework agreement, we emphasize that these minimum and maximum quantities initially established by the Contracting Authority in the procurement documentation and subsequently in the framework agreement represent estimates of quantities that might be requested over the entire duration of the framework agreement and not the exact quantities that will be purchased, the latter potentially being lower than, equal to or higher than those estimated, depending on the actual needs of the Contracting Authority. The Promising Purchaser reserves the right/option to supplement the quantity estimated in the procurement documentation by up to a maximum of 50% of the maximum quantity for the framework agreement/subsequent contract, for each individual product category. The price of the items that will be purchased additionally under the review clause will be that in the financial proposal forming the basis of the framework agreement (adjusted, where applicable, according to the adjustment formula); the period during which this option may be used by the Promising Purchaser: throughout the validity period of the framework agreement/subsequent contract. In view of the above review clause, the estimated value of the procedure, respectively of each individual lot, was expressed as a range, the minimum value of the range representing the estimated value of this procedure according to which the tenders will be evaluated, while the maximum value represents the estimated value that also includes the value of possible supplements under the review clause. The low-value modification provided for in Article 221(1)(f) of Law No. 98/2016 is treated and calculated separately from the modification pursuant to Article 221(1)(a) of Law No. 98/2016.
