Romania – Gas supply mains construction work – Execution of rehabilitation / systematization / optimization works for natural gas distribution systems, as well as the establishment of new natural gas distributions

The contracting entity intends to initiate the sectoral procurement procedure having as its object the award of a framework agreement for the execution of rehabilitation / systematization / optimization works for natural gas distribution systems, as well as the establishment of new natural gas distributions, organized into lots, as follows: Lot 01: Brasov, Covasna Lot 02: Prahova Lot 03: Giurgiu, Arges, Dambovita, Teleorman Lot 04: Dolj, Olt, Valcea, Gorj Lot 05: Bucuresti, Ilfov Lot 06: Calarasi, Ialomita, Constanta, Braila, Galati, Vrancea, Buzau, Tulcea Number of days before the deadline for submission of tenders by which clarifications may be requested: 18 The deadline, expressed as the number of days, within which the Contracting Entity will respond clearly and completely to all requests for clarification: on the 11th day before the deadline established for the submission of tenders. The minimum and maximum quantities that could be requested during the entire framework agreement/lot on the basis of subsequent contracts are estimated in the Specifications, part of the award documentation. Review clauses pursuant to art. 236 of Law no. 99/2016: Considering that the award documentation contains a minimum set of specific information regarding estimates of the minimum and maximum quantities that could be requested during the entire framework agreement, as well as estimates of the minimum and maximum quantities that could be the subject of a single subsequent contract among those to be awarded during the framework agreement, we emphasize that these minimum and maximum quantities initially established by the contracting entity in the award documentation and subsequently in the framework agreement represent estimates of quantities that could be requested during the entire framework agreement and not the exact quantities that will be purchased, the latter being potentially lower than, equal to, or higher than those estimated, depending on the actual needs of the contracting entity. In this regard, considering that the effects of the framework agreement mainly concern establishing the terms and conditions governing the public procurement contracts to be awarded during a certain period, particularly with regard to the unit price and, where applicable, the quantities envisaged, the Promising Purchaser reserves the right/option to supplement the quantity estimated in the award documentation by up to a maximum of 50% of the maximum quantity estimated for the framework agreement, for each category of work separately. The price at which additional purchases may be made under this review clause is that in the financial proposal underlying the signing of this framework agreement (adjusted, where applicable, according to the adjustment formula provided by the specific legislation). The modification of the framework agreement under this review clause falls within the non-substantial modification regulated by art. 240 para. (1), letter a) of Law no. 99/2016, having all the elements provided by art. 2 para. (1)-(2) of ANAP Instruction no. 1/2021. The object of this procedure is the procurement of rehabilitation/systematization/optimization works for the natural gas Distribution System, as well as the establishment of new natural gas distributions, in accordance with those described in the specifications – part of the award documentation. The estimated minimum and maximum quantities relating to the framework agreement and the subsequent contract are included in the annex because the size of the sections in the data sheet/contract notice does not permit their completion.
