4-year Framework Agreement – Execution of routine maintenance works “Maintenance of bridges, overpasses, culverts, tunnels. Maintenance of retaining walls and prevention of the effects of flooding – for a period of 4 years Lot 1 - SDN Brașov, Lot 4 - SDN M. Ciuc, Lot 5 - SDN Sf. Gheorghe, Lot 6 - S.A.S. A. In accordance with the provisions of Article 160(1) of Law No. 98/2016, the deadline by which any interested economic operator has the right to request clarifications or additional information regarding the procurement documentation is no later than 21 days before the deadline for submission of tenders. B. In accordance with the provisions of Article 160(2) of Law No. 98/2016, the contracting authority will respond clearly and completely to all requests for clarification/additional information on the 11th day before the deadline for submission of tenders. During the performance of the framework agreement, the contracting parties have the right to agree to amend the clauses by addendum, including where circumstances arise that harm their legitimate commercial interests and that could not have been foreseen on the date the subsequent contract was concluded, in accordance with Article 221(1)(a), (e), and (f) of Law No. 98/2016 on Public Procurement. Reasons for the amendments: Changes to the quantities of works for an item in the subsequent contract; Changes to the quantities and characteristics of an item in the subsequent contract; Legislative changes or changes to technical rules / regulations / standards / STAS standards; Changes resulting from the abandonment of certain work items; Extension of the duration of the subsequent contract due to the occurrence of circumstances beyond the control of the Contracting Authority and the Contractor. The limits of amendments to the framework agreement will be in accordance with Law 98/2016 and will comply with the situations provided for in Article 221: < 15% of the price of the framework agreement, pursuant to Article 221 para. letter f); duration of the subsequent contract – extension by a maximum of 4 months (Adverse weather conditions). 4-year Framework Agreement – Execution of routine maintenance works “Maintenance of bridges, overpasses, culverts, tunnels.
