“Equipment rental services for recycling to a depth of up to 50 cm and in situ crushing of mineral material with dimensions ranging from 3.1 cm–31.5 cm for the Production Section – 2-year framework agreement”. Minimum estimated value: 222,000.00 lei excluding VAT Maximum estimated value: 9,990,000.00 lei excluding VAT Estimated value of the smallest Subsequent Contract: 111,000.00 lei excluding VAT Estimated value of the largest Subsequent Contract: 3,052,500.00 lei excluding VAT The minimum and maximum quantities of the framework agreement and subsequent contracts are in accordance with the Bills of Quantities attached to the Specifications. Subsequent contracts (min. 1, max. 3) relating to the framework agreement will be concluded depending on the equipment required to carry out the works performed in-house by the Production Section. This framework agreement does not constitute the legal basis for committing public funds. On the basis of this framework agreement, subsequent contracts constituting the legal basis for payment will be awarded. Any amendments that may occur during the contract performance period, embodied in review clauses, pursuant to Article 221(1)(a) of Law No. 98/2016, provided that they fall within the provisions of Article 221(7) of Law No. 98/2016, meaning that they do not constitute a substantial amendment under the contractual clauses of the Framework Agreement and the subsequent contract. Review clauses pursuant to Article 221(1)(a) of Law No. 98/2016, which anticipate possible amendments that may occur during contract performance, are as follows: 1. Parties to the framework agreement / Contracting parties; 2. Unit price. Price adjustment of the Framework Agreement / Price of the subsequent contract – Adjustment of unit prices; 3. Duration of subsequent contracts; 4. Quantities; 5. Payment methods and recovery of receivables 6. Subcontractors. Third parties; 7. Unforeseeable circumstances, pursuant to the clauses of the FA (Chapter 12) and subsequent contract (Chapter 17). A. In accordance with the provisions of Article 160(1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information concerning the tender documentation is 8 days before the deadline for submission of tenders. B. In accordance with the provisions of Article 160(2) of Law No. 98/2016, as subsequently amended and supplemented, the Contracting Authority establishes a single deadline by which it will respond clearly and completely to all requests for clarification/additional information, on the 6th day before the deadline established for submission of tenders. *Any request for clarification submitted after the date mentioned under point A) will be considered late. It is intended to procure Equipment rental services for recycling to a depth of up to 50 cm and in situ crushing of mineral material with dimensions ranging from 3.1 cm–31.5 cm for the Production Section – 2-year framework agreement. The services concern the execution of cold recycling works in situations where the existing road structure contains coarse-grained mineral material, requiring its in situ crushing prior to the actual recycling process. The equipment made available by the service provider through the provision of rental services will be used in works to be performed in tandem, using two recyclers owned by DRDP Cluj, ensuring the continuity and efficiency of on-site operations. Estimated value of the framework agreement: - Minimum estimated value: 222,000.00 lei excluding VAT - Maximum estimated value: 9,990,000.00 lei excluding VAT - Estimated value of the smallest Subsequent Contract: 111,000.00 lei excluding VAT - Estimated value of the largest Subsequent Contract: 3,052,500.00 lei excluding VAT Frequency and value of the subsequent contracts to be awarded: a minimum of 1 and a maximum of 3 subsequent contracts/year will be concluded. The minimum and maximum quantities relating to the framework agreement are included as annexes to the tender documentation / specifications.
