Machinery rental services for the Production Department – Spraying equipment required for priming – 2-year framework agreement Estimated value of the framework agreement for a period of 24 months: - Maximum estimated value: 1,190,000 lei excluding VAT - Minimum estimated value: 42,500.00 lei excluding VAT Estimated value: Smallest subsequent contract: 21,250.00 lei excluding VAT. Largest subsequent contract: 212,500.00 lei excluding VAT. Frequency and value of the subsequent contracts to be awarded: min. 1 - max. 4 - per year. The contracting authority reserves the right to modify the contract pursuant to Article 221 of Law 98/2016, provided that these modifications do not fall within the provisions of Article 221 para. 7 of Law 98/2016, i.e. they do not constitute a substantial modification. Review clauses pursuant to Article 221 para. (1) letter a) of Law No. 98/2016, which anticipate possible modifications that may occur during the performance of the contract, are as follows: 1. Parties to the framework agreement / Contracting parties; 2. Implementation period of the subsequent contract; 3. Quantities; 4. Payment methods and recovery of claims 5. Inspections/testing/verifications 6. Subcontractors. Third parties in accordance with the clauses of the framework agreement (Chapter 12) and subsequent contract (Chapter 17). Deadlines for submitting/responding to requests for clarifications/additional information: A. In accordance with the provisions of Article 160 para. (1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which any interested economic operator has the right to request clarifications or additional information in connection with the procurement documentation is no more than 18 days before the deadline for submitting tenders. B. In accordance with the provisions of Article 161 para. (1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which the contracting authority will respond clearly and completely to all requests for clarification/additional information is the 11th day before the deadline established for submitting tenders. *Any request for clarification submitted after the date mentioned in point A) will make it impossible for the contracting authority to provide a response within the deadline mentioned in point B), and consequently any request for clarification within the mentioned deadlines will be considered late. The procurement of machinery rental services for the Production Department – Spraying equipment required for priming is sought. Estimated value of the framework agreement: - Minimum estimated value: 42,500.00 lei excluding VAT - Maximum estimated value: 1,190,000 lei excluding VAT - Estimated value of the smallest Subsequent Contract: 21,250.00 lei excluding VAT - Estimated value of the largest Subsequent Contract: 212,500.00 lei excluding VAT Frequency and value of the subsequent contracts to be awarded: a minimum of 1 - maximum of 4 - subsequent contracts/year will be concluded. The minimum and maximum quantities relating to the framework agreement are included as annexes to the procurement documentation / specifications. 1. Total duration of the contract: 24 months from the entry into force of the contract 2. At the current date, at DRDP Cluj level, framework agreement No. 25/6016/07.10.2025, concerning the provision of similar services, is valid for 24 months (07.10.2027). Under this framework agreement, 3 subsequent contracts were awarded for the entire maximum quantity included in the framework agreement, with the latest subsequent contract No. 25/6016/3/12.03.2026 being valid until 31.12.2026. Thus, the framework agreement resulting from this procurement will enter into force after framework agreement No. 25/6016/07.10.2025 and subsequent contract No. 25/6016/3/12.03.2026, currently in force, terminate by operation of law (upon expiry, fulfillment of the subject matter of the framework agreement / subsequent contract). Launching the procurement is necessary so that the activity of the Production Department is not disrupted and continuity of the rental services for Spraying Equipment required for priming is ensured.
