Equipment rental services for the Production Section - Front loader with bucket min. 2 cubic metres - 2-year framework agreement Maximum: 1,200,000.00 lei excluding VAT Minimum: 48,000.00 lei excluding VAT Value of the smallest Subsequent Contract: 24,000.00 lei excluding VAT Value of the largest Subsequent Contract: 240,000.00 lei excluding VAT The minimum and maximum quantities of the framework agreement and the subsequent contracts are in accordance with the Lists of Quantities attached to the Tender Specifications. Subsequent contracts (min. 1) relating to the framework agreement will be concluded depending on the equipment required for the execution of works carried out in-house by the Production Section. This framework agreement does not constitute the legal basis for committing public funds. On the basis of this framework agreement, subsequent contracts will be awarded that constitute the legal basis for payment. Any modifications that may occur during the contract performance period, embodied in review clauses, pursuant to Article 221(1)(a) of Law No. 98/2016, provided that they fall within the provisions of Article 221(7) of Law No. 98/2016, meaning that they do not constitute a substantial modification under the contractual clauses of the Framework Agreement and the subsequent contract. Review clauses pursuant to Article 221(1)(a) of Law No. 98/2016, which anticipate any modifications that may occur during the performance of the contract, are as follows: A. Parties to the contract - with regard to a change of name, status, shareholding, or company form that does not result in the creation of a new legal entity, or a change of registered office; - regarding the possibility of replacing the initial contractor B. Contract price - The contract price may be adjusted by updating it if legislative changes occur or local authorities have issued administrative acts concerning the introduction, modification, or removal of certain local fees/taxes whose effect is reflected in an increase/decrease in the costs on which the tendered prices were based, and in other situations provided for by law and in accordance with the adjustment formula. Price adjustment C. Payment methods: in the event of any legislative changes; A. In accordance with the provisions of Article 160(1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information concerning the procurement documentation is 18 days before the deadline for submission of tenders. B. In accordance with the provisions of Article 160(2) of Law No. 98/2016, as subsequently amended and supplemented, the Contracting Authority establishes a single deadline by which it will respond clearly and completely to all requests for clarification/additional information, on the 10th day before the deadline established for the submission of tenders. *Any request for clarification submitted after the date specified in point A) will be considered late. The minimum and maximum quantities relating to the framework agreement, as well as the estimated minimum and maximum quantities relating to a subsequent contract, are included as annexes to the procurement documentation / tender specifications. 1. Total duration of the contract: 24 months from the entry into force of the contract 2. As of the current date, subsequent contract No. 22/6003/7/20.11.2024 is in force at DRDP Cluj, valid until 31.03.2025. Initiating the procurement is necessary so that the activity of the Production Section is not disrupted and to ensure continuity of the rental services for a front loader with a bucket of min. 2 cubic metres.
