Opportunity description

The procurement of “Laboratory equipment and apparatus for the Faculty of Engineering,” in accordance with the specifications in the tender specifications. Number of days before the deadline for submission of tenders/applications by which clarifications may be requested: 20 days. The contracting authority will respond clearly and completely to all requests for clarification: on the 11th day before the deadline established in the contract notice for the submission of tenders. Any request for clarification must be submitted through SEAP (https://www.e-licitatie.ro). The completion of the award procedure through the conclusion of the public procurement contract is subject to the following suspensive condition, which will apply for a maximum period of 3 months from the tender submission deadline: The conclusion of the public procurement contract is conditional upon obtaining funding from own revenues/the state budget, with the contract being signed only if the provisions concerning the commitment of expenditure from budgets falling under public finance legislation are complied with, and in compliance with the provisions of Decision No. 395/2016 approving the Methodological Rules for the application of the provisions concerning the award of the public procurement contract/framework agreement under Law No. 98/2016 on public procurement, as subsequently amended and supplemented. If, regardless of the reasons, funding from own revenues/the state budget is not obtained, the contracting authority will apply the provisions of Article 212(1)(c), second sentence, of Law No. 98/2016, as subsequently amended and supplemented, making it impossible to conclude the public procurement contract. Tenderers in this procedure understand that the Contracting Authority and/or MEC cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority and/or MEC were notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/suspensive clause, assuming full liability in relation to any damage they might suffer in the situation described.
