Opportunity description

The supplier will deliver the products in the requested quantity to the contracting authority's headquarters, having the characteristics/specifications contained in the submitted and accepted tender, in compliance with the minimum requirements specified in the tender specifications. Delivery will be performed by the supplier in accordance with the deadline undertaken in the technical proposal, but no later than the deadline requested in the tender specifications, which runs from the date of signing the supply contract. Any request for clarifications must be submitted in SEAP (https://e-licitatie.ro/). Pursuant to the provisions of art. 160 of Law 98/2016, amended by GEO 107/2017, economic operators interested in the procedure will request clarifications or additional information regarding the procurement documentation 18 days before the deadline established for the submission of tenders, and pursuant to art. 161 of Law 98/2016, amended by GEO 107/2017, the contracting authority's response will be transmitted on the 11th day before the deadline established for the submission of tenders. SUSPENSIVE CLAUSE - this public procurement contract award procedure is initiated subject to the following suspensive clause: The award of the public procurement contract is conditional upon the allocation of the amounts related to the financing of the project for the 2026 budget year, necessary for the procurements provided for in the project, such that the completion of the award procedure through the conclusion of the public procurement contract is subject to the following condition: - the conclusion of the public procurement contract is conditional upon the allocation of the amounts related to the financing of the project for carrying out the Project activities, signing the contract being possible only if the amounts covering the expenditures provided for the 2026 budget year are secured, including the commitments of the Contracting Authority through the signing of the contract. - if the amounts requested by the Contracting Authority for the procurement that is the subject of the award procedure do not materialize within a maximum of 110 working days from the deadline for submission of tenders, the Contracting Authority will apply the provisions of art. 212 para. (1) letter c) second sentence of Law no. 98/2016, the conclusion of the public procurement contract being impossible. - Tenderers in this procedure accept the use of the above suspensive condition, assuming full responsibility in relation to any losses they might incur in the situation described.
