Opportunity description

The procurement of repair and maintenance services for the computer equipment of the fixed and mobile rovinieta control cameras-DRDP Cluj- 2-year framework agreement is sought. The maximum value of the framework agreement is 851,286.50 lei excluding VAT, the minimum value of the framework agreement is 81,800.00 lei excluding VAT. The value of the largest subsequent contract is 425,643.25 lei excluding VAT. The minimum and maximum quantities of the framework agreements and subsequent contracts are in accordance with the Lists of quantities attached to the Specifications. This framework agreement does not constitute the legal basis for committing public funds. On the basis of this framework agreement, subsequent contracts will be awarded that constitute the legal basis for payment. The contracting authority reserves the right to modify the contract pursuant to art. 221 of Law 98/2016, provided that these modifications do not fall under the provisions of art. 221 para. 7 of Law 98/2016, meaning that they do not constitute a substantial modification. Review clauses pursuant to art. 221 para. (1) letter a) of Law no. 98/2016, which anticipate possible modifications that may occur during the performance of the contract, are as follows: a) Contracting parties to the Framework Agreement/subsequent contract; b) Unit price; c) Duration of the framework agreement/subsequent contract: The duration of the Framework Agreement may be extended, with the agreement of the parties, from 24 months up to 48 months under the conditions of art. 221 letter e) of Law no. 98/2016, in the following situations: - the extension is necessary for the completion of the objective stipulated in the Framework Agreement, without substantially modifying it; - a situation or event has occurred that entitles the Promising Service Provider to a modification of the Implementation Duration of the Framework Agreement/Subsequent Contract, based on supporting documents submitted by the Promising Service Provider and approved by the Promising Purchaser, a modification that is not due to the fault of the Promising Service Provider. - the maximum value of this Framework Agreement was not fully used during the initially established period, due to a reduced number of technical failures occurring in the computer equipment of the fixed and mobile rovinieta control cameras. - in the case of the final Subsequent Contract to be concluded under the Framework Agreement, the duration of the Subsequent Contract may be extended depending on the needs of the Promising Purchaser at that time and may exceed the validity period of the Framework Agreement. d) Payment methods and recovery of claims; e) Inspections/checks; f) Subcontractors.Third parties. g) Quantities; h) Extension of services to a new place of business; A. In accordance with the provisions of art. 160 para. (1) of Law no. 98/2016, as subsequently amended and supplemented, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information regarding the procurement documentation is 18 days before the deadline for submission of tenders. B. In accordance with the provisions of art. 160 para. (2) of Law 98/2016, as subsequently amended and supplemented, the Contracting Authority establishes a single deadline by which it will respond clearly and completely to all requests for clarification/additional information, on the 11th day before the deadline established for the submission of tenders. *Any request for clarification submitted after the date mentioned in point A) will be considered late. The value of the largest subsequent contract is 425,643.25 lei excluding VAT. The minimum and maximum quantities relating to the framework agreement, as well as the estimated minimum and maximum quantities relating to a subsequent contract, can be found as annexes to the procurement documentation/specifications. Frequency and value of the subsequent contracts to be awarded: minimum 1 subsequent contract per year and maximum 5 subsequent contracts per year. The award of subsequent contracts will be made according to the needs of DRDP CLUJ.
