The contracting authority is procuring a coastal maritime patrol vessel. Pursuant to Article 221(1)(a) of Law No. 98/2016 on public procurement, the contracting authority uses contract review clauses within the procurement procedure as follows: A. Review clause concerning the replacement of the products offered with latest-generation products The contracting authority specifies that it will use the review clause for the delivery of latest-generation products if, during the validity period of the contract, the manufacturer of the products initially offered has declared the products initially offered to be end-of-sale/end-of-life/end-of-support. This clause includes all equipment fitted on the vessels. When the review clause is applied, the contract value will not change, and replacement proposals will be analyzed by the contracting authority so that the technical specifications of the newly proposed products are equivalent or superior to the technical specifications of the products initially offered. The procurement will be financed from non-reimbursable external funds under call BMVI/2023-2024/SA/1.2.2, as well as from allocations from the 2021-2027 National Programme for Border Management and Visas / state budget, in accordance with information letter No. AM26/1011132/07.05.2026 received from the funding body. Requests for clarification regarding the procurement documentation shall be submitted only through SEAP (https://e-licitatie.ro), by accessing the dedicated “Questions” section in the details of the ongoing procurement procedure. The contracting authority will respond clearly and completely to all requests for clarification/additional information on the 11th day before the deadline for submission of tenders, provided that these requests were submitted within the period specified in SECTION I, namely 19 days before the deadline for submission of tenders. To comply with the principle of equal treatment, interested economic operators shall comply with the provisions of ANAP Notification No. 247 regarding the method for submitting requests for clarification and additional information concerning procurement documentation / responses issued when public procurement contract award procedures are conducted by electronic means (online), meaning that the documents attached in the “Questions” section SHALL NOT CONTAIN THEIR IDENTIFICATION DATA, since these will become public when the response is transmitted by the contracting authority! The contracting authority is procuring a coastal maritime patrol vessel in accordance with the provisions of the tender specifications and the attached technical specifications, and the estimated value of the procurement includes all activities provided for in the tender specifications. The contracting authority will conclude a public supply contract with a duration of 26 months from the date it is signed by the last party. Delivery period: 24 months. The 2-month interval between the delivery deadline and the contract duration is allocated to the contracting authority and includes specific activities for making payment. Procedure: open.
