Romania – Mastics – Bituminous mastic - 4-year framework agreement

The procurement of bituminous mastic is necessary for carrying out in-house maintenance works (sealing fissures and cracks) by the National Roads Sections / Motorways Section subordinated to CNAIR S.A. through D.R.D.P. Cluj. Estimated value of the framework agreement: • The maximum value of the framework agreement is 1,780,000.00 lei excluding VAT; • The minimum value of the framework agreement is 178,000.00 lei excluding VAT. The estimated value of the largest subsequent contract: is 356,000 lei excluding VAT. The minimum and maximum quantities of the framework agreement and of the subsequent contracts are in accordance with the Lists of Quantities attached to the Tender Specifications. Subsequent contracts (min. 1) relating to the framework agreement will be concluded depending on the equipment required for carrying out the works performed in-house by the Production Section. This framework agreement does not constitute the legal basis for committing public funds. On the basis of this framework agreement, subsequent contracts constituting the legal basis for payment will be awarded. Any amendments that may occur during the contract performance period, materialized in review clauses, pursuant to Art. 221 para. (1) letter a) of Law No. 98/2016, provided that they fall within the provisions of Art. 221 para. 7 of Law No. 98/2016, meaning that they do not constitute a substantial modification under the contractual clauses of the Framework Agreement and the subsequent contract. Review clauses pursuant to Art. 221 para. (1) letter a) of Law No. 98/2016, which anticipate any amendments that may occur during the performance of the contract, are as follows: A. The parties to the contract - with regard to a change in name, status, shareholding, company form, which do not result in the creation of a new legal entity, or a change of registered office; - regarding the possibility of replacing the initial contractor B. Contract price - The contract price may be adjusted by updating it if legislative changes occur or local authorities have issued administrative acts concerning the establishment, modification or waiving of certain local fees/taxes whose effect is reflected in the increase/decrease of the costs on which the tendered prices were based, and in other situations provided for by law and in accordance with the adjustment formula. Price adjustment C. Payment methods: in the event of any legislative changes; A. In accordance with the provisions of Art. 160 para. (1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information concerning the procurement documentation is 18 days before the deadline for submission of tenders. B. In accordance with the provisions of Art. 160 para. (2) of Law 98/2016, as subsequently amended and supplemented, the Contracting Authority establishes a single deadline by which it will respond clearly and completely to all requests for clarification/additional information, on the 11th day before the deadline established for submission of tenders. Any request for clarification submitted after the date mentioned under point A) will be considered late. Min. quantity 20 to, max. quantity: 200 to.
