The subject matter of the framework agreement consists of the procurement of repair and maintenance work on buildings, platforms, sewerage systems, natural gas supply networks, windows, doors, electrical installations, sanitary installations, hydrant networks, etc. at the locations of the Romanian Automotive Register where the Contracting Authority carries out its activities, for the purpose of maintaining them at the level of the technical standards and regulations in force concerning quality and operational safety, taking into account their special purpose. Pursuant to the provisions of Article 160(1) of Law 98/2016 (hereinafter referred to as “Law 98”) and Article 103(1) of the Methodological Norms for Law No. 98/2016, approved by Government Decision No. 395/2016 (hereinafter referred to as the “Norms”), any interested economic operator has the right to request clarifications or additional information in connection with the procurement documentation, subject to a deadline of 18 days before the deadline for submission of tenders. In accordance with the provisions of Article 160(2) and Article 161(1) of “Law 98”, as well as Article 27(2)-(4) and Article 103(2) of the “Norms”, the contracting authority will provide a consolidated, clear and complete response to all requests for clarifications/additional information on the 11th day before the deadline established for submission of tenders. The contracting authority will not respond to a request for clarifications/additional information received within the period of 17 days before the deadline established for submission of tenders, the request being considered to have been submitted late. The Romanian Automotive Register intends to conclude a framework agreement, with a duration of 4 (four) years from the date of entry into force of the Framework Agreement, establishing the terms, conditions, as well as the legal, financial, technical and administrative framework for awarding the subsequent Contracts, with a view to ensuring that the Tenderers safely, promptly and cost-effectively perform the work necessary to provide an optimal setting and environment for carrying out activities safely and under good conditions (security, health, etc.), according to the needs of the Contracting Authority and within the budget allocated for this purpose, as follows: • repairs to yards (milling, repairs, replacement of asphalt mixtures, concrete, paving, etc.) • restoration of enclosures • floor repairs (parquet, Tarkett, etc.) • interior repairs (shotcreting, skim coating, painting, etc.) • ceiling repairs • replacement of exterior joinery • replacement of interior joinery • handling and transport of materials • repairs to terraces + roofs - dismantling of terraces + roofs • restoration of sloped concrete • restoration of thermal insulation • restoration of the thermal insulation protection layer • restoration of terrace waterproofing • restoration of waterproofing and drains • restoration of roofs • restoration of roof coverings • removal of exterior plaster • restoration and repair of exterior plaster • removal of interior plaster • restoration and repair of interior plaster • repairs to sewerage networks • repairs to natural gas supply networks • electrical installations • sanitary installations • etc. The Contracting Authority is initiating the award procedure for a framework agreement to be concluded with a single economic operator. During the implementation period of the framework agreement, the Contracting Authority will conclude the subsequent contracts. It is estimated that 48 subsequent contracts will be concluded, with one subsequent contract covering one or more neighboring RAR-RA offices. The work included in the respective subsequent contract may be performed simultaneously at a maximum of two neighboring representative offices. The contracting authority issues the order by indicating the location or property where this work is required. The requirements of the specifications are minimum and mandatory. Accordingly, any tender for work that deviates from the provisions of the specifications, presents work with characteristics inferior to those provided therein, or does not satisfy the requirements imposed therein will be rejected as non-compliant. Estimated value of the framework agreement: • minimum framework agreement value: 10.069.965,34 lei excluding VAT; • maximum framework agreement value: 37.968.261,90 lei excluding VAT; • value of the smallest subsequent contract: 374.104,65 lei excluding VAT; • value of the largest subsequent contract: 4.045.966,63 lei excluding VAT - Given that the procurement documentation contains a minimum set of specific information concerning estimates of the minimum and maximum quantities that might be requested throughout the entire framework agreement, as well as estimates of the minimum and maximum quantities that might be the subject of a single subsequent contract among those to be awarded during the term of the framework agreement, we emphasize that these minimum and maximum quantities initially established by the contracting authority in the procurement documentation and subsequently in the framework agreement represent estimates of quantities that might be requested throughout the entire framework agreement and not the exact quantities that will be procured, the latter potentially being lower than, equal to or greater than those estimated, depending on the actual needs of the contracting authority. - The Promising Purchaser reserves the right/option to supplement the quantity estimated in the procurement documentation by up to a maximum of 15% of the maximum quantity for the framework agreement/subsequent contract, for each category of work separately. The price of the work to be performed additionally under the review clause will be that stated in the financial proposal forming the basis of the framework agreement (adjusted, where applicable, according to the adjustment formula), and the period during which this option may be exercised by the Promising Purchaser is throughout the entire validity period of the framework agreement/subsequent contract. - In view of the above review clause, the estimated value of the procedure, as stated in section II.1.5 of the data sheet, will be expressed as a range, with the minimum value of the range representing the estimated value of this procedure according to which the tenders will be evaluated, while the maximum value represents the estimated value that also includes the value of possible supplements under the review clause. - Thus, the maximum value of the range stated in section II.1.5 of the data sheet, namely the value resulting from possible supplements, is 43.663.501,19 lei excluding VAT. - Modification of the framework agreement/subsequent contract under this review clause is governed by Article 221(1)(a) of Law No. 98/2016 and falls within the scope of a non-substantial modification, having all the elements provided for by Article 2(1)-(2) of ANAP Instruction No. 1/2021.
