The subject matter of the contract consists of updating the technical design and executing capital repair works for the SE Breakwater of Tomis Port and the platform associated with this breakwater and Site organization, in accordance with the specifications of Tender Specifications No. 28157/21.07.2026. Under the contract, the Contractor’s designer will prepare the following documentation: Technical Expert Assessment Documentation comprising: o Specialist studies (Topographical, Geotechnical, Hydrographic, etc.) • Topographical study endorsed by OCPI, • Bathymetric study endorsed by a verifier, • Geotechnical study endorsed by a verifier, • Hydrographic study endorsed by a verifier, Etc. Documentation for obtaining the Urban Planning Certificate, including site organization; it shall comply with the legislation in force (Law No. 50 of 1991, as amended) and be aligned with the requirements of the local administration issuing the Urban Planning Certificate; it shall include the Technical Memorandum and representative drawings, which will be submitted for approval by the CTE of CN APM SA before being filed with the competent public authorities to obtain the Urban Planning Certificate. Specialist studies required under the Urban Planning Certificate Documentation for obtaining the endorsements requested through the Urban Planning Certificate, and, whenever necessary, documentation requested by another authority will also be prepared in accordance with the legal provisions in force. Technical Documentation for obtaining the Building Permit (D.T.A.C.) and Technical Documentation for Organization of Execution (D.T.O.E.) -- includes the Technical Memorandum and representative drawings, which will be submitted for approval by the CTE of CN APM SA before being filed with the competent public authorities to obtain the Building Permit. The “Technical Design with Execution Details, Tender Specifications and Bills of Quantities” Documentation (PTh + DDE + CS + LC) will comply with the framework content provided for in Government Decision 907/2016 regarding the preparation stages and framework content of the technical-economic documentation relating to investment objectives/projects financed from public funds. o Long-term behavior monitoring design, including a plan for installing benchmarks for topographical measurements Technical assistance Taking into account the technical expert assessment prepared and following site visits and analysis of the measurements and investigations performed, the following intervention works were found to be necessary to remedy the identified deterioration: Restoration of the breakwater profile Restoration of the platform associated with the breakwater Reinforcement of the parapet wall In accordance with Tender Specifications No. 28157/21.07.2026. Contract duration: 48 months, of which: - 12 months for design services and - 36 months for execution of the works Estimated value excluding VAT: 81.149.100,00 lei - Design Update: 380.089,00 lei, excluding VAT - Execution of Works: 80.206.046,00 lei, excluding VAT - Site Organization: 562.971,00 lei, excluding VAT The deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information concerning the procurement documents is 18 days before the deadline for submission of tenders. The contracting entity establishes 2 (two) deadlines by which it will respond to all requests for clarifications/additional information, as follows: • The contracting entity will respond, by a first deadline of 25 days before the deadline for submission of tenders, to all requests for clarification submitted by the economic operator during the period from publication of the procurement documents until the date falling 35 days before the deadline for submission of tenders; • The contracting entity will respond, by a 2nd deadline of 11 days before the deadline for submission of tenders, to the remaining requests for clarification submitted 18 days before the deadline for submission of tenders. The contracting entity reserves the right to publish during this 2nd deadline responses to clarifications for which the responses should have been published by the first deadline indicated above. The 2 (two) deadlines for responding to clarifications do not affect the economic operator’s right to submit requests for clarification throughout the entire period from publication of the contract notice until the 18th day before the deadline for submission of tenders established by the contracting entity. The contracting entity will not respond to requests submitted after this deadline. Information regarding a Joint Tender (association, if any) Tick “Yes” in its own ESPD (response), Part II: Information concerning the economic operator, Section A: Information about the economic operator, “Is the economic operator participating in the public procurement procedure together with others?” and complete the additional information requested in this regard. If a joint tender is submitted, each economic operator that is a member of the association will submit an ESPD in which it will include information regarding how the economic and financial capacity and/or technical and professional capacity requirements are met, as well as the association agreement, in accordance with Form No. 2, accompanied by information about the association in accordance with the Annex to Form No. 2, from the “Forms” Section of the Procurement Documents, stamped and signed by the tenderer’s legal representative/authorized representative. • Updated supporting documents demonstrating fulfillment of all qualification and selection criteria, in accordance with the information contained in the ESPD, will be submitted only by the tenderer ranked first in the interim ranking drawn up upon completion of the evaluation of tenders. The associates will be jointly, severally, and individually responsible for performance of the contract in accordance with its terms. The leader of the association is responsible in its own name and on behalf of the Association for performance of the contract. Contracts concluded between the leader of the association and the associates will become annexes to the contract concluded between the contracting entity and the leader. Information regarding the supporting third party/parties (if any) The tenderer is required to provide information regarding third-party support. - tick “Yes” in its own ESPD (response), Part II: Information concerning the economic operator, Section A: Information about the economic operator, “Is the economic operator participating in the public procurement procedure together with others?” and complete the additional information requested in this regard. The tenderer will complete the ESPD with information regarding the existence of third-party support, including the measures envisaged by it to access the necessary resources at any time, to which the ESPD and the firm commitment of the supporting third party/firm commitments of the supporting third parties must be attached, indicating the effective manner in which the supporting third party/supporting third parties will ensure fulfillment of the commitment, in accordance with Forms No. 3a and 3b, accompanied by the Declaration/Declarations of the third party/parties in accordance with the Annex to Form No. 3b, from the “Forms” Section of the Procurement Documents. Together with the ESPD, the tenderer will submit the Support Commitment accompanied by documents, which will constitute annexes to the respective commitment and indicate the effective manner in which the supporting third party will ensure fulfillment of its own commitment. Where the support of the third party/parties concerns non-transferable resources, the commitment assures the contracting authority/entity of fulfillment of the obligations assumed through it if the contractor encounters difficulties during performance of the contract. Note: For the purpose of verifying fulfillment of the qualification requirements, the contracting entity may request from the supporting third party, at any time during the evaluation process, additional documents and information relating to the commitment given or the documents submitted (Article 56 of Government Decision 394/2016). If the third party/parties does/do not meet the relevant capacity criteria or falls/fall under one of the grounds for exclusion provided for in Articles 177, 178, 180, the contracting entity will request, only once, that the economic operator replace the supporting third party/parties, without prejudice to the principle of equal treatment provided for in Article 2(2)(b) of Law No. 99/2016.
