Delegation by concession of the management of the sanitation service - the activity of operating voluntary waste collection centers for waste from individuals in the Municipality of Arad. The Municipality of Arad obtained non-reimbursable funding under the National Recovery and Resilience Plan – Component 3: Waste Management, Sub-investment I1.a: Establishment of voluntary collection centers, through a financing contract concluded with the Ministry of Environment, Waters and Forests, having as its object the construction of four voluntary collection centers (CAV) for waste originating from individuals within the municipality. During the period 2022–2024, feasibility studies and technical-economic indicators were prepared and approved through successive decisions of the Local Council of the Municipality of Arad for each site, as follows: a) CAV 1 - Soseaua de centură FN, next to the Arad Sorting Station; b) CAV 2 - Strada Tarafului; c) CAV 3 - Calea 6 Vânători, next to Arad Penitentiary; d) CAV 4 - Zona Industrială Sud, near the intersection of Străzii Cornelia Bodea with DJ 682. Each voluntary collection center is designed with concrete platforms, fencing, administrative cabins, vehicle scales, monitoring systems and specific facilities: large containers for bulky waste, containers dedicated to recyclable streams, specially arranged spaces for hazardous household waste, electrical and electronic equipment, batteries and waste oils. At the same time, the project provides for the implementation of an integrated IT system for waste traceability, as well as public information and awareness-raising activities. The centers will ensure the separate collection of the following types of waste: a) recyclable paper, metal, plastic and glass waste, b) bulky waste (furniture, mattresses), c) textile waste, used tires, used vegetable oils, d) waste electrical and electronic equipment, batteries and accumulators, e) hazardous household waste, f) construction and demolition waste, g) other types of waste established by the local public administration authorities. To ensure the continuity of the sanitation service that forms part of the sphere of community public utility services, specifically the activity carried out in voluntary collection centers (CAV), the following objectives are pursued: a) ensuring environmental protection through the separate and appropriate collection of the various types of waste brought by citizens, reducing the quantity of waste disposed of through improper dumping and preventing pollution of the urban environment; b) increasing the recovery and recycling rate of collected waste, in accordance with national and European objectives concerning the circular economy and the reduction of the quantity of municipal waste; c) compliance with the legal requirements and waste management rules imposed by environmental protection legislation; d) increasing the level of responsibility and convenience for citizens by providing a suitable and accessible space for the voluntary delivery of waste that cannot be collected through the ordinary system (for example: bulky waste, WEEE, textiles, construction and demolition waste, etc.). The provision of high-quality services within the voluntary collection centers contributes to the sustainable development of the community, the reduction of pollution and the protection of public health, while also ensuring responsible waste management. The operator shall ensure: a) compliance with the legislation, rules, prescriptions and regulations concerning occupational safety and health, emergency situations, water management, environmental protection, monitoring the behavior of structures over time, as well as compliance with all its obligations incumbent upon it under the law and the service regulations and which it assumed through the management delegation contract; b) the operation, maintenance and repair of installations and machinery by authorized personnel, depending on the complexity of the installation and the specific nature of the workplace; c) the preparation of annual servicing and repair plans carried out using its own resources and third parties; d) keeping records of the operating hours of specialized vehicles, installations and machinery; e) ensuring the personnel necessary to perform the activities assumed through the delegation contract; f) its own provision of the specific installations and equipment necessary to perform the activities under the conditions established by the contract; g) providing UAT Municipality of Arad, the National Regulatory Authority for Community Public Utility Services, the Environmental Protection Agency, the Environmental Guard, and the Environmental Fund Administration with all requested information and access to the documentation and individual instruments on the basis of which it carries out the concessioned sanitation activity, under the conditions of the law; h) the application of high-performance management methods that lead to reduced operating costs, including through the application of the competitive procedures provided for by the legal rules in force concerning public procurement, while also ensuring compliance with the specific requirements of environmental protection legislation; i) keeping waste management records and periodically reporting the situation to the competent authorities, in accordance with the regulations in force and contractual requirements. j) the operator of the voluntary collection centers is obliged to report periodically to the Intercommunity Development Association Integrated Waste Management System – Arad County (ADISIGD), as well as to the delegating authority, the quantities of waste collected, broken down by waste types and streams; k) reporting shall be carried out in accordance with letter j), monthly, quarterly and annually, for the purpose of ensuring waste traceability, monitoring management streams and fulfilling the indicators and targets assumed under the SMID project; l) reporting concerning the Intercommunity Development Association Integrated Waste Management System is for information and monitoring purposes and does not affect the powers of the Contracting Authority concerning control, the identification of non-compliance and the application of contractual penalties. The sanitation activity shall be performed so as to ensure: a) continuity of the activity, regardless of the season and weather conditions, in compliance with the contractual provisions; b) correction and adaptation of the activity provision arrangements to the user's requirements; c) verification of the quality of the activity performed; d) quality control of the service provided; e) compliance with the internal instructions/procedures for performing the activity; f) keeping documents concerning service provision up to date; g) compliance with the sanitation service regulations approved by the local public administration authority, under the conditions of the law; h) performance of the activity based on the principles of economic efficiency, with the objective of reducing the costs Procedure: open.
