Opportunity description

The procurement of repair services is sought for the Ammann Easy Batch 90 asphalt mixture production plant, including spare parts, of the Production Section - DRDP CLUJ - 2-year framework agreement. The maximum value of the framework agreement is 935,000.00 lei excluding VAT; the minimum value of the framework agreement is 764,000.00 lei excluding VAT. The largest subsequent contract: 462,500.00 lei excluding VAT. The minimum and maximum quantities of the framework agreements and subsequent contracts are in accordance with the Lists of Quantities attached to the Specifications. This framework agreement does not constitute the legal basis for committing public funds. On the basis of this framework agreement, subsequent contracts will be awarded, which constitute the legal basis for payment. The contracting authority reserves the right to amend the contract pursuant to Article 221 of Law 98/2016, provided that these amendments do not fall within the provisions of Article 221(7) of Law 98/2016, meaning that they do not constitute a substantial amendment. Review clauses pursuant to Article 221(1)(a) of Law No. 98/2016, which anticipate possible amendments that may occur during the performance of the contract, are as follows: 1) Contracting parties to the Framework Agreement 2) Duration of the framework agreement; 3) Implementation period of the subsequent Contracts 4) Unit prices of the products and/or services; 5) Quantities; 6) Payment methods and recovery of receivables 7) Subcontractors. 8) Unforeseeable circumstances A. In accordance with the provisions of Article 160(1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information concerning the procurement documentation is 18 days before the deadline for submission of tenders. B. In accordance with the provisions of Article 160(2) of Law 98/2016, as subsequently amended and supplemented, the Contracting Authority establishes a single deadline by which it will respond clearly and completely to all requests for clarification/additional information, on the 11th day before the deadline established for submission of tenders. *Any request for clarification submitted after the date mentioned in point A) will be considered late. Repair services for the Ammann Easy Batch 90 asphalt mixture production plant, including spare parts, of the Production Section - DRDP CLUJ - 2-year framework agreement. The maximum value of the framework agreement is 935,000.00 lei excluding VAT; the minimum value of the framework agreement is 764,000.00 lei excluding VAT. The largest subsequent contract: 462,500.00 lei excluding VAT. The minimum and maximum quantities relating to the framework agreement, as well as the estimated minimum and maximum quantities relating to a subsequent contract, are included as annexes to the procurement documentation / specifications. Frequency and value of the subsequent contracts to be awarded: minimum 2 subsequent contracts per year and maximum 6 subsequent contracts per year. The subsequent contracts will be awarded according to the needs of DRDP CLUJ.
