Romania – Road-maintenance works – FRAMEWORK AGREEMENT for the execution of routine and periodic maintenance works on municipal roads in the Municipality of Lugoj

The subject of the procedure is the award of the framework agreement for the execution of routine and periodic maintenance works on municipal roads in the Municipality of Lugoj, for the purpose of maintaining all road components in technical conditions suitable for the continuous and safe flow of traffic, with a framework agreement valid for 48 months to be concluded. The works to be awarded under this award procedure are presented in the technical specifications attached to this contract notice, with compliance with the applicable legal provisions and the elements designed and highlighted in the Technical Specifications prepared by S.C. BUZU R.R.B. DESIGN S.R.L., attached to this documentation. The contracting authority intends to conclude a Framework Agreement valid for 48 months from signing. The framework agreement (F.A.) will be concluded with the 2 tenderers ranked in the first 2 places in the ranking of admissible tenders. No electronic auction will be conducted to determine the economic operators that will be parties to the framework agreement. During the Framework Agreement, it is estimated that 1–2 Subsequent Contracts will be concluded annually, depending on the needs identified and the budgetary funds allocated for this purpose. In accordance with the provisions of Article 160(1) of Law 98/2016, as subsequently amended and supplemented, the deadline by which any economic operator interested in participating in the public procurement procedure has the right to request clarifications or additional information in connection with the procurement documentation is 18 days before the deadline for submission of tenders. The contracting authority establishes that the deadline by which it will respond to all requests for clarifications or additional information is the 11th day before the deadline for submission of tenders. The repair works will be carried out throughout the entire road and bridge network administered by the Municipality of Lugoj, for the purpose of maintaining all road components in technical conditions suitable for the continuous and safe flow of traffic. The maintenance works will be carried out in compliance with the applicable legal provisions and the elements designed and highlighted in the Technical Specifications and technical documentation prepared by S.C. BUZU R.R.B. DESIGN S.R.L., attached to this documentation. The contracting authority intends to conclude a Framework Agreement valid for 48 months from signing with the two tenderers ranked in the first two places following the tender evaluation process, with subsequent contracts to be signed with them depending on the contracting authority’s needs and the available budget. During the Framework Agreement, it is estimated that 1–2 Subsequent Contracts will be concluded annually, depending on the needs identified and the budgetary funds allocated for this purpose. The estimated forecast quantities of works to be procured over the entire duration of the framework agreement are presented in these technical specifications. The contracting authority informs potential tenderers that the respective quantities are estimates, with the purchaser awarding subsequent contracts strictly according to its own needs and financial availability. The purchaser is under no obligation to contract the minimum or maximum quantities under the framework agreement and may request any works from the service provider’s technical proposal, in any quantities, up to the maximum value of the framework agreement. The quantities and values established in the framework agreement may be modified similarly to the provisions of Article 221 of Law 98/2016. The works will be carried out on the basis of subsequent works contracts concluded between the parties depending on the contracting authority’s needs as well as the allocated budget, in strict compliance with the standards and regulations in force. The contractor is required to ensure appropriate organizational and technological measures for strict compliance with the provisions of the regulations and standards in force and fulfillment of contractual obligations. WORKS CONCERNING ROUTINE REPAIRS ON THE ROAD NETWORK that form part of the framework agreement: • maintenance (repair) of defects in the road complex with 2 bituminous layers • maintenance (repair) of defects in the road complex with 1 bituminous layer • maintenance (repair) of defects in the road structure with 2 bituminous layers • maintenance (repair) of defects in the road structure with 1 bituminous layer • maintenance (repair) of defects in the pavement of the road structure with 2 bituminous layers • maintenance (repair) of defects in the pavement of the road structure with 1 bituminous layer • maintenance (repair) of defects in the road structure with 1 bituminous layer through in situ recycling • raising covers to grade • replacement of existing 20x25 cm cement curbs • repairs to lined ditches and gutters • clearing earth ditches • signage for works during execution • road markings • construction of drainage inlets The estimated minimum and maximum values of the framework agreement and of a subsequent contract are presented below: • Minimum value of subsequent contract, lei excluding VAT = 1.734.064; • Maximum value of subsequent contract, lei excluding VAT = 9.523.862; • Minimum value of framework agreement, lei excluding VAT = 17.340.064; • Maximum value of framework agreement, lei excluding VAT = 37.190.082 The estimated minimum and maximum quantities of works under the framework agreement and under a subsequent contract are presented in the Technical Specifications.
