The subject of the contract is “Rehabilitation of DJ 643D, DN 65C (Bulzeşti) – Prejoi – Înfrăţirea – Frăţila – Vâlcea County Boundary, km 0+000 – 16+000, section km 0+000 - 8+000” - remaining work to be carried out (design and execution) – design and execution in accordance with specifications no. 4738/23.03.2026. Any economic operator has the right to request clarifications or additional information in connection with the procurement documentation, pursuant to Article 160(1) and (2) of Law 98/2016. The deadline for economic operators to submit requests for clarification is 20 days before the deadline for submission of tenders. The deadline by which the contracting authority will respond clearly and completely to requests for clarification/additional information submitted by economic operators is 10 days before the deadline for submission of tenders. The subject of the procurement is the conclusion of a works execution contract (design and execution) – REMAINING WORK TO BE CARRIED OUT, for the investment objective “Rehabilitation of DJ 643D, DN 65C (Bulzeşti) – Prejoi – Înfrăţirea – Frăţila – Vâlcea County Boundary, km 0+000 – 16+000, section km 0+000 - 8+000”. The subject of the contract is the completion of all design services and all works necessary for the acceptance of the investment objective. The contracting authority (CA), Dolj County Council, concluded with the Contractor, the consortium S.C. ERPIA S.A. - SC ARMEANCA PREST COM SRL, led by SC ERPIA S.A., Contractual Agreement no. 32/13.03.2019, having as its subject the execution of works for the aforementioned investment objective. Although the CA repeatedly notified the Contractor regarding the defective performance of the contract, the latter did not fulfil its contractual obligations within the time limits and under the conditions stipulated in the contract, which is why the CA decided to terminate it due to failure to fulfil the contractual conditions, with approximately 70% of the works having been completed. Following termination of the contractual agreement, the CA was required to procure a technical expert assessment identifying the remaining works to be carried out, as well as works to remedy non-compliant works, where applicable. At the same time, the CA is required to initiate a new works procurement procedure for the design and execution of the remaining works, with a view to the acceptance of the investment objective. The Beneficiary will make available to the Contractor all relevant documents in the Beneficiary’s possession concerning the technical design, endorsements, agreements and executed works. The Contractor shall be deemed to have inspected and examined the construction site and its surroundings, analysed the data and satisfied itself, before submitting the tender, as to all relevant aspects, such as, but not limited to, the form and nature of the construction site, the extent and nature of the works, the materials required to execute the works, access routes to the construction site, utilities and, in general, to have obtained all information concerning the risks. Given that the Contractor is deemed to have established its prices on the basis of its own calculations, operations and estimates, the Contractor shall, without payment of any additional cost, comply with every obligation and execute every work provided for in the contract. By signing the contract and accepting the value stated in the contract, the Contractor assumes full responsibility and the costs associated with the risk of failing, through its own fault, to complete the works within the contractual period and of a possible extension of the contract execution period. The Contractor shall not remove or replace any member of the team of experts without the Beneficiary’s prior approval. The Contractor shall organise the works and take all measures to prevent and combat accidental pollution, bearing full responsibility for the damage caused, decontamination of the area and payment of the costs. The Contractor shall take into account that the works will be executed under traffic conditions; therefore, during the execution of the works, the contractor is obliged to take all necessary measures so as not to disrupt road traffic. The main activities are: - Preparation of the D.T.A.C. for continuation of the works in accordance with the technical expert assessments; - Preparation of the technical design for the remaining work to be carried out in accordance with the technical expert assessments, with a view to completing the investment objective; - Provision of technical assistance by the designer during the execution of the works; - Execution of all works - remaining work to be carried out, relating to the investment objective. The works shall be executed only on the basis of the Building Permits made available by the CA, the technical execution design, the site instructions issued up to the current stage of the works, the technical expert assessment, endorsements and agreements. The works shall be executed in strict compliance with the specific applicable legislation, regulations and standards in force on the date the works are executed. Procedure: open.
