The economic operator declared the winner of the award procedure will prepare the technical documentation at the following stage: Technical documentation for authorizing the execution of construction works – D.T.A.C., Technical documentation for organizing the execution of works – D.T.O.E., Technical documentation for authorizing the execution of demolition works – D.T.A.D. (if applicable), Technical execution design – P.T.E., Technical assistance from the designer during the execution of the works, Technical execution design updated as of the date of completion of the works – As built, Technical documentation for obtaining the Water Management Authorization (if applicable), Documentation for endorsements and agreements, and execution of works for “Modernization of the road infrastructure of county road 205L on the sections: int. Expenditure for the relocation/protection of utilities, lump sums will be tendered, to be detailed at the technical design level according to requirements. The subject matter of the contract to be awarded through this public procurement procedure consists of the procurement of services for preparing the technical documentation at the following stage: Technical documentation for authorizing the execution of construction works – D.T.A.C., Technical documentation for organizing the execution of works – D.T.O.E., Technical documentation for authorizing the execution of demolition works – D.T.A.D. (if applicable), Technical execution design – P.T.E., Technical assistance from the designer during the execution of the works, Technical execution design updated as of the date of completion of the works – As built, Technical documentation for obtaining the Water Management Authorization (if applicable), Documentation for endorsements and agreements, and execution of works for “Modernization of the road infrastructure of county road 205L on the sections: int. DJ 205D (Grumaz) - Vrâncioaia, Spinești – Păulești - Tulnici - int. DN2D”. The duration of execution of the works is 30 months. The duration for providing the design services is 3 months. The technical assistance services from the designer will be provided throughout the entire period of execution of the works. The number of days before the deadline for submission of tenders by which clarifications may be requested is 20 days. The Contracting Authority will respond only once to requests for clarification, on the 11th day before the deadline for submission of tenders. The project is to be submitted for funding under the South-East Regional Programme 2021-2027, Specific Objective 3.2 Development and growth of sustainable, climate-resilient, intelligent and intermodal national, regional and local mobility, including improved access to TEN-T and cross-border mobility, Action 4.1 - Investments intended for the rehabilitation and modernization of road infrastructure of regional importance to ensure connectivity to the TEN-T network, Call PRSE/4.1/2/2025. The Contracting Authority specifies that it will conclude the public procurement contract with the tenderer declared the winner, subject to a resolutory condition, meaning that failure to obtain funding through the South-East Regional Programme 2021-2027 within a maximum of 12 months from the date of signing the public procurement contract and establishing the GBE will result in the automatic termination of the contract. If the resolutory condition is fulfilled (lack of funding), the contract shall be deemed terminated with retroactive effect, as though it had never been concluded, in accordance with Art. 1401 of the Civil Code. The parties agree that, until the date on which the condition is fulfilled or the maximum 12-month period expires, the Contractor shall not commence activities that would generate costs, and the Contracting Authority shall not be liable for the payment of any compensation if the contract is terminated.
