Opportunity description

Supply of technological equipment, in accordance with the requirements of the Tender Specifications. The public procurement contract award procedure is initiated subject to this suspensive clause, meaning that the conclusion of the public procurement contract is conditional upon the allocation of budgetary appropriations for this purpose, and the contract will be signed in compliance with the provisions concerning the commitment of expenditure from budgets falling under the legislation on public finances. Having regard to the provisions of Law 98/2016 on public procurement and Government Decision No. 395/2016, as subsequently amended and supplemented, the Contracting Authority specifies that it will conclude the contract with the tenderer declared the winner only insofar as the funds required for the procurement are secured through the allocation of budgetary appropriations for this purpose. If, regardless of the reasons, the budgetary appropriations are not allocated, the Contracting Authority, after receiving notification that funding has not been granted, reserves the right to cancel the award procedure, provided that there is no other source of funding, in accordance with the provisions of Article 212(1)(c), second sentence, of Law 98/2016, as subsequently amended and supplemented, as it will be impossible to conclude the public procurement contract. Number of days before the deadline for submission of tenders by which clarifications may be requested: 17 days. NOTE: Pursuant to Article 161 of Law No. 98/2016, as subsequently amended and supplemented, insofar as clarifications are requested in a timely manner, the contracting authority's response to these requests will be published in SEAP on the 11th day before the deadline established for the submission of tenders (see the deadlines in the contract notice published in SEAP).
