Opportunity description
The subject of this procurement is the signing of a Framework Agreement establishing the terms and conditions, as well as the legal, financial, technical and administrative framework for the award of subsequent Contracts, with a view to ensuring that the Tenderers provide the services described in the specifications, namely the technical and economic documentation necessary and mandatory for carrying out the investments targeted by the contracting authority. The duration of subsequent contracts concluded during the validity period of the framework agreement may exceed the duration of the framework agreement and shall extend until the complete completion of the activities constituting their subject matter, taking into account any forms of extension, warranty period, remediation of defects, etc. The description of the services is detailed in the Specifications, which contain all the information necessary for preparing the tender. The subject of this procurement is the provision of design services consisting of: technical assessment, energy audit and initial energy performance certificate, documentation for the endorsement of intervention works, feasibility study, detailed urban development plan, documentation for obtaining the approvals required in the urban planning certificate and technical documentation for authorizing construction works, technical design and execution details, technical assistance, energy performance certificate upon completion of the works, and the designer’s opinion and consultancy. The general objective of the framework agreement is to improve citizens’ living conditions by continuing and/or carrying out large-scale investments; prior to commencing the investments, the contracting authority/authorities must contract services for the preparation of technical and economic documentation. The Contracting Authority intends to adopt measures that will lead to an improvement in the standard of living, measures that will require extensive construction works for new facilities, interventions, rehabilitation, modernization and development of infrastructure and buildings. The construction works for which the procurement of services for preparing technical and economic documentation is intended are classified into 6 main investment directions: · Modernization and development of basic urban infrastructure; · Environmental protection and ecological management of the territory at sector level; · Increasing the quality of housing within the intervention area; · “Smart”/intelligent solutions for the benefit of the urban community; · Supporting the existing business environment; · Development of urban tourism. Estimated value of the largest subsequent contract: 87,426,000 lei. Number of days before the deadline for submission of tenders by which clarifications may be requested: 18 days. Clarifications requested after this deadline will no longer be taken into consideration. The contracting authority will respond clearly and completely to all requests for clarification/additional information on the 11th day before the deadline established for the submission of tenders. The technical and economic documentation to be prepared must be such as to lead to the achievement of the investment objectives, as described in the annex to the specifications. Estimates of the minimum and maximum quantities that might be requested over the entire duration of the framework agreement and those that might be the subject of a single subsequent contract among those to be awarded during the duration of the Framework Agreement are set out in the annex to the specifications. Modification of the framework agreement/public procurement contract during its validity period may be carried out under the conditions provided for in Art. 221 of Law No. 98/2016 and the provisions of ANAP Instruction No. 1/2021. Given that the procurement documentation contains a minimum set of specific information concerning estimates of the minimum and maximum quantities that might be requested over the entire duration of the framework agreement, as well as estimates of the minimum and maximum quantities that might be the subject of a single subsequent contract among those to be awarded during the duration of the framework agreement, we emphasize that these minimum and maximum quantities initially established by the contracting authority in the procurement documentation and subsequently in the framework agreement represent estimates of quantities that might be requested over the entire duration of the framework agreement and not the exact quantities that will be procured, the latter being potentially lower than, equal to or higher than those estimated, depending on the actual needs of the contracting authority. The Promising Purchaser reserves the right/option to supplement the estimated quantity stated in the procurement documentation by up to a maximum of 50% of the maximum quantity for the framework agreement/subsequent contract, for each category of services separately. The price of the items to be additionally procured under the review clause will be that stated in the financial proposal underlying the framework agreement (adjusted, as applicable, according to the adjustment formula); the period during which the Promising Purchaser may exercise this option: throughout the validity period of the framework agreement/subsequent contract. The low-value modification provided for by Art. 221 para. (1), letter f) of Law No. 98/2016 shall be treated and calculated separately from the modification under Art. 221 para. (1), letter a) of Law No. 98/2016.” During the implementation period of the framework agreement, subsequent contracts shall be concluded subject to the allocation of budgetary appropriations for this purpose, and signature shall take place in compliance with the provisions concerning the commitment of expenditure from budgets falling under the legislation on public finances. Subsequent contracts may also be financed from other legally established financial sources. To finance the execution of works relating to subsequent contracts concluded during the implementation of the framework agreement, the contracting authority will access projects and/or programs financed from national and European Union funds (ROP, etc.), without this description being exhaustive. Tenderers participating in this procedure understand that the Contracting Authority cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority was notified of the existence of such damage. Tenderers participating in this procedure accept the use of the above special conditions/suspensive clause, assuming full liability in relation to any damage they might suffer in the situation described.
