The procurement of Quarry products – Chippings, grades 4-8, 8-16, 16-22.4, 16-31.5 mm, Crushed sand 0-4 mm for the Morlaca asphalt plant, DRDP CLUJ, is sought. Estimated value of the framework agreement Minimum 69,200.00 lei excluding VAT Maximum 4,994,400.00 lei excluding VAT Value of the smallest Subsequent Contract: 34,600.00 lei excluding VAT Value of the largest Subsequent Contract: 529,600.00 lei excluding VAT The minimum and maximum quantities of the framework agreements and subsequent contracts are in accordance with the Lists of quantities attached to the Specifications. At least 2 subsequent contracts will be concluded per year. This framework agreement does not constitute the legal basis for committing public funds. On the basis of this framework agreement, subsequent contracts that constitute the legal basis for payment will be awarded. The contracting authority reserves the right to modify the contract pursuant to Article 221(1)(a) of Law No. 98/2016 with reference to: 1. The parties to the framework agreement / Contracting parties; 2. Duration of the framework agreement / subsequent contract; 3. Quantities; 4. Subcontractors.Third parties; 5. Payment methods and recovery of receivables; 6. Inspections/testing/verifications; in accordance with the clauses of the FA (Chapter 11) and subsequent contract (Chapter 17), in accordance with the provision in the framework agreement and the model subsequent contract. This framework agreement does not constitute the legal basis for committing public funds. On the basis of this framework agreement, subsequent contracts that constitute the legal basis for payment will be awarded. Subsequent contracts will be awarded according to the needs of DRDP CLUJ. The number and duration of the contracts will be established according to the budgetary funds that can be allocated for this purpose. Deadlines for submitting/responding to requests for clarifications/additional information: A. In accordance with the provisions of Article 160(1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which any interested economic operator has the right to request clarifications or additional information relating to the award documentation is no more than 18 days before the deadline for submission of tenders. B. In accordance with the provisions of Article 161(1) of Law No. 98/2016, as subsequently amended and supplemented, the deadline by which the contracting authority will respond clearly and completely to all requests for clarification/additional information is the 11th day before the deadline established for submission of tenders. *Any request for clarification submitted after the date mentioned under point A) will make it impossible for the contracting authority to provide a response within the deadline mentioned under point B), and consequently any request for clarification within the mentioned deadlines will be considered late.
